Can Anybody Help Me Please.

    I got my CDL in May of 2006. In June of 2006 I got hired by C.R. England. I went out with my trainer for 6 weeks then I went out with my CAT and while I was driving with him I had my first incident that C.R. England called an accident in August 2006. I was on a back highway in Ohio when I went to make a tight right turn I checked my mirror and noticed that I had a busted tire on my trailer. I stopped # the next rest area and told her CAT about the busted tire and he said that he would take over driving to get them to a truck stop so they could get it fixed. When we got to the truck stop we noticed that the rim was cracked too. He called C.R. England and blamed it all on me and they believed him. They had me take a safety class and then put me back on the road. I leased out and drove for 5 months with a clean record until the first week of February 2007. I got to my D01 # 5am I was the first one in there dock for the day I was talking with one of the guys that worked there and he told me that the last guy in his dock the night before was so tried that he slammed into the dock so hard that he thought he broke it. Well the dock guy came out and told me that I had to talk to his manager before I could get my bills back. I asked why and he told me because I broke their dock. We went back to check it out and noticed that the rubber bumper was hanging half down. I told the manager that I would fix it for her if she had a screw but she said that they had a person who could do that. I explained to her that I didn’t hit her dock that hard to make it fall down and that’s when the dock guy stepped up and said that it might have been the guy from last night. She said that it didn’t matter because it was showing on me. She said that she would get with the person and see if they could fix it and that she wasn’t going to report it to C.R. England. Two weeks later I was # my D01 2 hours early I checked in and the girl told me that she had time to unload me since it was only 2 pallets. She told me to go ahead and get in the dock and come in and let her know if I needed help because the dock is kind of hard for a 53’ trailer to get into. I went back outside to check it out and this is what I was dealing with right in front of the dock was a dumpster, a dog pen with a dog inside, the pen was the same size as the dumpster. To the left of the dumpster was a huge snow pile and a light pole. On the right side of the dumpster was just parking lot space. The dock it self was very tight it had concrete walls on both sides with rails on top if that. I went back inside to ask the girl for help getting in the dock or to see if she could just pull the pallets off with her forklift but she said that she was the only person in the store and that everybody else was away # a meeting. But she did tell me not to blindside back into it because nobody was able to do it that way. So I went back outside to try and get it on my own. I swear I moved my trailer inch by inch and got out and check about 30 times. At the very last second when I was almost lined up with it I slow let up off the clutch and the DOT bumper hit the rail of the right side of the dock and it fall over. The girl came outside and seen what happened and said what a #####, then she went to climbing into the trailer and get a piece of the product out to go and give it to her customer who was waiting in the store. I finished getting in the dock and then went inside to talk to her about the rail and there was two other people inside with her and one was on the phone with C.R. England. C.R. England left me out on the road until May 2007 then they pulled me in to the headquarters and told me that I had 3 accidents on my DAC now. My safety manager told me that I had to sign a wavier for him to able to go and talk to the head boss on my behalf to see if they would just retrain me and just me back out on the road again. I told him that only one of the incidents was my fault and that was the only one I was claiming. Well they ended up firing me and I have been fighting with them ever since to try and get them to take the 2 accidents off my DAC. I even tried going through the DAC people themselves but that didn’t even work. I can’t even get with any other companies with them on there and to make matters worse they say that because I was a lease operator when I turned in my truck they had to fix a lot of stuff they keep my last pay check and still say that I owe them almost $600. I check my credit report this week and now C.R. England put the cost of the whole #### truck on my credit so now they are really ####### me. What am I to do about this whole mess I really want to get back on the road. I have put in tons of applications online, in person, with OTR companies, and local companies I just don’t know what to do any more. Can anybody help me out ? Know any companies that might hire me ?

    Get a lawyer fast, speak to no one else until you do. Not anyone here can help you out with this situation. It is unfortunate for you but without a lawyer I don't think you can get this resolved. I say get the lawyer or change careers.

    Hiring an attorney is good advice but without a job how will you get the money to pay for a lawyer?

    I suggest contacting some o/o's with a few trucks. They may be willing to give you a shot if they are desparate enough for a driver. Just be straight with the guys you approach. Nothing ventured nothing gained.

    Yes I agree, thats a real bad start...And the whole truck on your credit??? was it a lease or a buy?? Unreal though, sorry to hear it, but youve probably got a while to go before you in a truck again..And alot fighting it sounds like..

    If they are charging you for the truck then go get it. Either it is yours or it is not yours right?
    So if they say it is yours then get it. ? :biggrin_2556: ?
    Or did I misunderstand? :biggrin_25524:
