I'm not going to push the subject but my truck is an extension of my home, unless the door is open they don't have the right to come in without permission or a warrant......
On a 2nd note I have a good friend of mine that was involved in a head on fatality accident and was not at falt but anytime someone is killed everything besides what's in your pockets becomes evidence DOT ended up going thru his truck finding receipts and did not match his logbook. When DOT come in for the adit it did not go very good stuff that may had got looked over he was nailed for, He no longer has his own numbers!

Being involved in a fatality they'll go back to the first time you crapped your diapers. Whole new ball game there. Though drivers considered a truck their home it doesn't fit the permanent resident definition. It doesn't even fall under POV when you are under the FMCSA. They have all legal rights to search or let's say inspect items covered in the regs which includes sheets. If they happen to see something in the course of an inspection then they can proceed farther. But they can't go through your luggage or cabinets without reasonable suspicion or permission.Matt43324, Swamprat55 and tow614 Thank this.

When we began fueling regularly at a one of the larger Canadian Truck stops, the fuel reciepts weren't time stamped. Then they changed the computer system or something and they were time stamped. One day I saw the owner (or manager?) of that location and I asked him why and the stamp disappeared a week later. -
If they are inside they have the right to look thru anything....I don't and will not give them the rightCondoCruiser Thanks this.

and just to be clear, you CANNOT be convicted of anything based upon receipts
receipts are only hearsay in a court of law, so if you contest the ticket, barney has to subpoena walmart, or whatever other store representative to outline the procedures of how the receipt was generated and validate its veracity
it is enough to give you a ticket, but if you contest the ticket, it will be thrown out -
Aren't all regs. covered under "implied consent", or is it just drug/alcohol testing?

I view Barney as the enemy. Barney is out to destroy your career and livelihood and the more American blue collar workers he can destroy the more medals he gets from his superior. People complain about jobs being shipped overseas but they forget about the cancer doing its part to destroy the American worker and its name is Barney. When I see a DOT cop, state trooper, small town cop, I don't let my guard down because I know they hide behind the badge and gun and their world revolves around seeing how many careers and families they can damage or destroy. I firmly believe when they cause someone to lose their job,they meet at a local tavern later giving the high-fives.

^^ That's a pretty bold statement and rather broad it would seem. I simply can't think in those terms. If I truly felt that way, I believe I would be unable to do this job and would look for another line of work.
If a truck driver can wholesale feel this way about another profession counter to his/hers, It makes sense now why so many non-truckers hate truckers. If you really feel that way, how can you in good conscious encourage others contemplating driving to pursue this trade? That statement seems out of character for you, Chinatown -
I don't think that's the case. The last couple of times I was inspected, the troopers were decent, just did the inspection,passed me, and sent me on my way. and this is with a company that hasn't had a single "alert" score since CSA started (and yes its a small, good company). that's considering both times I was on e-logs, and the first one was just a level 3 and the guy seemed pleased about companies using e-logs. From my experience most cops I've dealt with have been decent, and usually I just "yes sir" and "no sir" when I am asked anything, nor do I start in with the "I'm a sovereign citizen and you can't blah blah blah blah...!" As far as I'm concerned, anyone who brags about how they told a cop off, flipped them the bird, (and got a way with it)or called the marshalls on the scale house is full of #####.
Judging from some of the idiocy I see from drivers these days, (and yes I'm including the experienced billy-bigrigger morons who think they are a "real trucker" because they drive 70 + mph on an icy road...one of these days karma is gonna bite you in the keister), its no wonder some cops can't stand us.
That's not to say law enforcement is totally without corrupt, incompetent, or tyrannical people(Minnesota's "fatigue checklist" scam is an example of stupidity). Just the minority of them that make the rest look bad. I like to deal with them as little as possible myself, just I think the outside world takes on a whole different appearance when you put on the badge and a gun and now you are expected to enforce laws you may have once scoffed at, and you get to see the worst in people, and the some of the blood and guts you have to witness when you are the first person to respond to a fatal wreck caused by simple, basic stupidity.Swamprat55, 25(2)+2 and BobcatVolvo Thank this.
