Can drivers be forced to quit for being too old?

    Yup. That about sums it up. The attatude nowadays is always "i demand more money and less work or else" meanwhile even if they get it, i always hear them ##### about being broke and pissed at the small handful who do work and work hard who always have a ton of cash while they struggle to make rent.

    Its kinds funny watching my dad outwork guys in their teens and 20s like its nothing. He is not as fast, not as energetic or whatever else. Yet he shows up, does the job at a steady consistsnt pace then leaves while they bumble around trying to do half the work. Ill be honest i wish i was half as good at work as him. Hell he trained me and even i struggle to keep up sometimes. Then again he is also a lot more patent, kind and stoic then i am lol.

    We’ve got a couple over 70 at my yard. They usually turn 400-600 miles a day & 3-5 deliveries

    Ive.talked.to.several drivers in their 70's over the years. Talked to one at the Flying J in N Platte that was 81. I guess as long as you can pass the DOT physical you are good to go.

    Truck drivers are among a small group of workers than a company can set maximum age limits for. Airline pilots are another example, they are forced to retire at age 65 if employed by an airline certificated under 14 CFR Part 121.

    Some trucking companies set a maximum age for drivers and it is legal under the guise of safety.

    No they can't but they can just fire you. This nation, with one exception of a state, is a no-cause termination nation.

    Aren't there Fed laws against age discrimination? Even in a RTW state, you can't fire someone for being Black, Brown, queer or a dozen other things...

    I have worked for several companies who that drivers in their late 60s to mid 70s pulling hazmat tankers. There's a hand here in town who hauled fuel for many years, and although physically able his mental state declined to where he couldn't do the job properly anymore. So they asked him to retire, and now he shuttles tanker trailers back and forth for a local trailer shop. Last time I saw him a few years ago he said he had just turned 80.

    Old hands become old hands for a reason. It would be foolish to terminate them on account of their age, and probably illegal as well.

    The lawyers call that a "constructive discharge." My lawyer says it's difficult to prove in court, but it is enough of a thing that there's a legal term for it.
