Can Fuel Haulers Smoke In Their Cab?

    By law you cant light or smoke anything in the cab or within 25 feet or the truck and trailer. Back in my tanker days while haulin whiskey and grain alcohol I smoked while driving, just had to watch when and where.

    Back before there was orange barrels and cones for highway construction they use acute little thing called a smudge pot.
    Some of ya'll would freak the hell out if you had to drive for miles with these things burning beside you every few feet.:biggrin_25521: Back then tanker drivers just trucked on by them.[​IMG]

    i know my uncle used to load 6-7000 gal of scotch back in the 1960-70's.
    there was a distillery called "publicker industries" was located at the base of the walt whitman bridge on philly side. the plant is gone now. the scotch got delivered to north jersey/nyc on a daily basis.

    I was a tanker yanker once. Hauled gasoline. Wanted to see how much I had loaded so I climbed up, opened up that big spinny thing and looked down in there. It was dark in there!

    So I lit a match.:biggrin_2553:

    And that is perfectly legal. Only the driver can't smoke within 25'.

    Go back and read driver oppression , chapter 2, right behind "pay" and what they don't get.:biggrin_25525:

    I think you have misinformation chalupa. A driver had an incident where a patron walked by smoking a cigarette while he was delivering fuel. The driver asked her to please put out her cigarette. She refused and came closer. The driver asked again and again she refused. The driver then picked up his fire extinguisher and put it out for her. Police were called and she got a ticket. The driver was within his legal right to not only protect himself but the general public as well.

    Smoking is not permitted within 25 ft. by ANYONE. Not just the driver. I see people all the time smoking while pumping gas. I have no problem asking them to please put it out and everyone I have approached has been compliant.

    Looks like some drivers need to be retrained. The law requires that you know these laws before you haul any hazmat. See CFR49 parts 100 to 177 §177.816 and Subpart H-Training §172.704. I think you'll find a lot of companies in violation.
