Can I file against the brokers bond?

    No, you were paid for the time according to your contract (I assume that) but to be expected the full load money, nope.

    take the $300 and take the load tomorrow, it beats chasing money.

    No technically your truck wasn’t loaded until you have your bill of laden you create signed by them. Until that moment, you don’t have a claim to that load, they can stick it there and take it off all day long.

    You never had a rate confirmation for the load they loaded on your trailer. You never even left the shipper with the load. How do you expect to get paid for a load with out a rate con that you never delivered!

    You can sue the broker sure. You can sue anyone for anything in the US. What will determine if you will win or not will be what is in the contract (rate con, carrier packet). Same with the bond, you can file, but it will be a waste of time as it will be denied.

    Oh, I figured since they started loading my truck (wrong load) so took it off, I was entitled to the full load pay. I told them no to the $300 that I was going to file on their bond Ans sue them if needed to get paid.

    Well crap, guess I got bad advise from another carrier. They said they do this all the time amd make up a bol saying receiver refused to sign. So I guess $300 was fair for my 3 hr. Wait?

    Aha, so let's commit fraud (making a fake BOL is fraud) and then take said fraudulent document to a court of law. What ever could go wrong with that advice? :)

    And $100/hr is fair or not would depend on local market conditions. I would guess most people would jump on that offer though.

    You didn't haul the load anywhere, you're not entitled to the 300 dollar layover pay he offered much less what that load you didn't go anywhere with paid.
