Can i legally go off duty for a couple hours to preserve my 70?

    Why would they? Ive done it many times. I get to a truck stop, take 3-4 hours off duty then back on the road I go

    If they ask, just tell them the lot lizard had her own place... or you would have logged SB.

    Log it off duty and be done with it.. Off duty is off duty, it's none of their business what you were doing...

    If you are free to do whatever you want, go where you want, and are relieved of responsibility for the equipment and lading, then you are off duty. Logging it on duty under circumstances is falsification of the log.

    Dot states while you are under dispatch you are on-duty, sleeper or driving!
    If are under dispatch and u stop at out back steak house to eat, they say you are on-duty because u r responsible for that equipment.
    Dot does allow the companies to relieve the driver from all responsibilty for personal brks while under dispatch! The driver had to be given permission prior to dispatch though! Many companies give u a meal card/personal brk card to cover this!
    The thing is if u r not away from that truck and u log u r off duty, its a false log!
    If ur body is in the sleeper then u can log sleeper! Logging sleeper does not mean u r sleeping, it meams ur body is in the sleeper!
    Anytime u can take ur body from a work situation do so! Nothing wrong or illegal aboutthat!
    Example: you see a traffic jam (or hear of one) get off next exit and go eat or lay down (good time to shower if u can :) that way u r getting ur 30 min brk instead and u are not wasting your driving/70 time sitting in traffic going no where! Of course thats if u can get off the road :)
    U r at a cusomer, they are loading/unloading see if they allow u to go to the sleeper while they load/unload! If u can then go to the sleeper. & log sleeper! Saves on 70 hr :)
    I call it utilizing your time legally! Of course if ur log dept says different you have to go with that!
    Remeber though if they are asking you to log a status u really r not on at that time thats falsifying. Companies can be stricter than dot regs but cant ask u to falsify or violate the rules!
    Ok that was long winded sorry lol!

    Define under dispatch . I have loaded Fridays at shippers that don't load weekends . I have then parked my tractor hooked to that trailer at a terminal near my house and gone home for a 48 hour break off duty , going back Sunday to leave to deliver Tuesday . Wasn't that under dispatch ?
    You are also ignoring the new ruling allowing logging off duty in a nonmoving CMV .
    Please provide a direct quote from the FMCSR stating " while you are under dispatch you are on-duty, sleeper or driving"

    He might be confusing the clarification for off-duty driving with general off-duty as I have never anywhere seen anything in the regs that states that you cannot log off-duty while under dispatch. That card that you are talking about? It allows you to log up to 1 hour off-duty for a meal breaks and such. I have honestly never heard of DOT citing anyone for doing this without the card and I would LOVE to hear if they did.
