Can I still file a claim against a broker's surety bond if there is a dispute over damage to the cargo?
background: was hauling used car that (already had many scratches), but shipper is claiming some of the damage occurred in transit. Consequently, they won't pay the broker who wont pay me. I would like to file a claim against the broker's surety bond, is that possible or would the dispute over damages have to be resolved first?

I would say file on the bond, and then the broker can fight with the customer over getting paid, and the customer can fight with you over the damages. Next time, take pictures. Lots and lots of pictures. Any and all damage gets photographed BEFORE you touch the car. Then, when these claims arise, you have proof to validate your theory that the damage was pre-existing. The broker still needs to pay you, though.

The broker still has to pay you the agreed rate. You are responsible to make good with the shipper.
Did you do an inspection noting any & all damages, including mentioned scratches? Do you have signatures at pick up & delivery? -
