Can I use AG exempt

    Fmcsa allows using pc on elog when doing ag. This is to facilitate gps tracking for IFTA vs turning elog off. Just got to add in comments ag 150 mile radius his exempt. This will keep you from a log falsification. I keep this in my permit book to assist dot with any confusion.

    Commodity has to be in harvest or planting. Storage out of season does not count. Refer to state in question USDA office or online for seasons. Milk is always in season :) periodically exemptions to the rule are passed by state governors in times of hardship.

    While true, a good number of states have defined planting and harvesting season for purposes of 395.1(k) as being from Jan 1 to Dec 31. Of course double check, but I know several of the states known for potatoes are that way.

    Doesn’t really have anything to do with if it’s exempt or not. If it’s on the list, it’s on the list.

    This could be misleading.

    The Feds determine which commodities are ag exempt. The individual states determine the annual harvest and planting seasons. Individual commodities have nothing to do with it at the state level, except Maryland and Delaware (figures). When we pick up fish feed in BC, we are on the clock in BC, go off the clock in WA, except December through January. I can assure you, we “plant” and harvest year round, but logic has nothing to do with the regulations.
