Can you carry a gun even with license in a cmv in texas

    My first driving job 14 years ago took us to Detroit every week. Sometimes Chicago. A fellow driver with this company was shot in the back trying to get away from a mugger. He died. I started carrying. Just because it has never happened, doesn't mean it won't. Hey here's an idea. Maybe I can just throw my log book at them.

    This applies to FREIGHT. The items you carry in your cab for personal use ARE NOT FREIGHT!!!

    Gawd! The lengths some people reach to so they can pretend to be right!

    Also: Texas statute takes precedent in intrastate operation. FMCSA does not apply until the vehicle crosses into another state. The carrier does not even have to be registered with a USDOT number to operate within a single state. It only needs commercial vehicle registration for that specific state. Jeezum!

    Injun, all respect, but I simply looked for some info, and posted what I found. I don't have the time, patience, or anything else it would take to spend countless hours researching a subject that means very little to me.

    I did note that the "carrying in performance of their duties" phrase must have some people misled or confused... and I think some people think that means having a gun while you're at work - it doesn't - it means being armed in the performance of your duties, like an armored car guard, or DOE escort.

    It looks like out west for the most part, it is legal as long as its not concealed, unless you have a concealed permit, then you could carry it concealed. But I'm sure most companies forbid it, because of liability issues.

    On the other hand, who is going to know youre carrying anyway? I wonder what the statistics of truckers being robbed or shot, wounded while on duty are......

    If it's more than 1 in 100,000 and could have been prevented if the driver

    was armed.......it's too many IMO.

    Being one who takes this seriously...I hired a lawyer to look into it for me back in 1990.

    There are no Federal laws against it...state laws have changed a lot since 1990 (all for the better), it gets complicated to abide by every states laws, but it can be done...the thing that needs to be clarified is shippers and receivers with "no firearms" signs...

    The states where these signs are worth the plastic they are printed on are getting fewer and fewer every day, with the passage of the so called "locked in a parked vehicle" type laws...that allow employees to have weapons in their vehicles at work.

    There is a lot to consider here...and wasting time and energy bantering with RoadMedic is not accomplishing ANYTHING...RoadMedic is entitled to his opinion just as much as we are ours...RoadMedic and I have had this conversation before...he respects my opinion, and I respect his...its a choice, its not one everybody is going to agree on.

    A few notes on carrying...

    If you are gonna do it...GET TRAINING...specific training...look up Gunsite (founded by Jeff Cooper) or Thunder Ranch (Clint Smith) or Michael Janich's Martial Blade Concepts (<<< also includes firearms training, the real stuff...Michael was trained by the late Rex Applegate), or I.C.E. TRAINING (by Rob Pincus)

    Know the law...some states have "duty to retreat" (run first, then shoot if you have to) others have "castle doctrine" (don't give me a reason)...doing the wrong thing in the wrong state will land you in prison.

    Don't try to be a hero...being in a gunfight is not like it is on TV.
