how about u tell us the whole story not just bitsand pieces here we are 20 posts and 2 pages and we dont even know what u did. how can u expect us to help u fully if u wont tell us.
im used to threads where u get half the story but this is rediculous
but as to what i can gather from this u damaged the truck period so call me old school but u should be the one to fix it and/or pay for it.
one last thing if u hit my truck i'd demand NEW parts not used. if i had to find the parts and got a good deal on used parts why in the world should i give u a deal? you damaged my truck! of course i gonna want u to give me the money for new. consider it a lesson learned the hard way employers and employees are just that dont confuse the 2
one last thing after re reading ur post used parts depending on what it is are not always plentiful sometimes u gotta buy new to get the truck back on the road and back to making money. i still agree fully with my earlier statement nothing wrong with what the owner is doing buisness is buisness
Can't get money for last trip

What Fisher Guy said. Give us the full story from start to finish if you expect us to help you.

I am not really here for judgment on the situation.
All I am looking,is some guidance on how to deal with employer's unfair behavior. -
Get a real job where you are not paid by a 1099. You're just asking for trouble with that crap.
Elendil Thanks this. -
If you damaged his truck, because of that 1099, you really have no recourse. Hell. You never worked for him according to the govt right now.
MJ1657 Thanks this. -

If you drive his truck and he tells you what load to go get you are an employee and can't be 1099ed. The biggest misconception with little owner operators. He's just dodging his tax and insurance responsibilties showing he is a sheister to begin with.
No one can freely take money out of your paycheck without a pre-written agreement. If you signed a contract when he hired you stating you are responsible for damages then he can.
Your recourse is a civil suit in small claims. He is suppose to have insurance to cover such expenses. He could counter sue for his deductible which is a separate issue. He's trying to make them all one and being judge and jury himself. The pay is one issue and the accident is another issue.
It's much easier to identify and not work for sheisters. 1099 ought to be a big red flag! Most drivers that do that just think about tax money they are saving and don't even worry about the IRS themselves. You have to think about benefits and how important they are to your future.
Here's a random answer from an attorney on the same question.
Elendil, joseph1135 and Crazy Alex Thank this. -
Re-read post 22. How do you expect advice if no one knows the full story? -
as for guidence the owner is not and i will repeat this is NOT being unfair from what YOU told us maybe if u were to clarify what happend maybe just maybe we would be inclined to form a better idea where u are coming from and will be more inclined to give u some advice on how to fight this case but from what u left us with and ur inabilty to tell us what happened i know i will have to side with the owner on this case
btw i am not an o/o im just a company driver just like u i have paid my fair shair of repair bills when i was first starting out so i will leave u with this
man up and take ur lumps like a man yea it sucks but u'll get over it if u still have a job u probally should thank him for letting u keep that job. if its a 1099 job someone said do the honerable thing and pay the man and find another jobskootertrashr6 Thanks this. -
Very bad advice!
