Cargo and property damage paid by company driver

    i just went to orientation with a company that makes company drivers sign a document stating that driver agrees to be financially responsible for any cargo damage and property damage. The amount will be decided by employer and customer and deducted from driver’s paycheck. Is this normal?

    It is illegal. The company can't force a deduction out of your wages of damages to anything.

    have never seen it ,myself and would NEVER sign one.

    I also won't sign the agreement to " lift 100lbs and carry it 100ft". meaning manually unload a truck ,by hand and re-pallet on dock.

    of, course they won't hire you, but I don't want to work for a company that wants me to agree to abuse.

    Sorry that will get tossed in court if an employee fights it. This is a company liability thing, not an employee liability thing.

    Every one I have seen has no means of protesting the accusation of damage, and that is where they get tossed because it opens the employee up to abuse.

    That's right. As the old saying goes, you can't sign away your rights. If it's illegal before you signed the document it's illegal afterwards.

    I worked for a company that made me buy a cell phone when I did not have one beforehand and service under my name and then reimbursed me for it on the back end each month. They then fired me without cause or reason and wanted the phone back. I told them get bent, it was my phone in my name. They said we paid for it so it's ours. I said no, you REIMBURSED ME for it. They tried to withhold my last paycheck to pay for the phone. A threat of legal action against them got me my final check in full.

    Now, I’m curious...what company is that, and did you walk out? If not, do you have a copy of that portion of the contract? I’d really like to see it. And BTW, Mr Ridgeline is right. I guess next, some company is going try try to hold company drivers financially responsible if the truck doesn’t get above a certain fuel economy.

    The “cargo damage” aspect is a real problem. Lots of cargo claims, small and large, have NOTHING to do with poor load securement or bad driving habits and events (such as hard braking or fast turns). I’d run from this company and never look back.

    If someone backs into you at a truck stop, it sounds like this company would like you to help fund some of the repairs costs, even if they might later collect from the offending carrier. These types of companies should be avoided at all costs.
