WRONG! WRONG! WRONG! There is no law preventing anyone from carrying in a CMV! I have had level 1 inspections with my firearm on my hip. I informed the inspecting officer I was armed after showing him my permit and he just said "OK" and went on with the inspection. I even got stickers.![]()

said i might have been wrong there. there are laws however that do prevent transporting firearms across state lines. and you said "permit" (key word there) is it a fccw or the basic ccw.
"theres no rule in the Federal Motor Carrier Safety Regulations (FMCSR) prohibiting you from carrying a gun in your truck. ( as i said i may have been wrong and clearly i was ) But, depending on what state youre driving in, you may not be able to legally carry a gun in your tractor. Remember, simply having a concealed gun permit in your home state doesnt exempt you from all other state laws."
the only Federal law on point is Title 18 Section 926(a)
TITLE 18--CRIMES AND CRIMINAL PROCEDURE
PART I--CRIMES
CHAPTER 44--FIREARMS
Sec. 926A. Interstate transportation of firearms
Notwithstanding any other provision of any law or any rule or
regulation of a State or any political subdivision thereof, any person
who is not otherwise prohibited by this chapter from transporting,
shipping, or receiving a firearm shall be entitled to transport a
firearm for any lawful purpose from any place where he may lawfully
possess and carry such firearm to any other place where he may lawfully
possess and carry such firearm if, during such transportation the
firearm is unloaded, and neither the firearm nor any ammunition being
transported is readily accessible or is directly accessible from the
passenger compartment of such transporting vehicle: Provided, That in
the case of a vehicle without a compartment separate from the driver's
compartment the firearm or ammunition shall be contained in a locked
container other than the glove compartment or console.
"There is no federal law prohibiting the driver from carrying a firearm in his rig. ( again more proof i was wrong in my earlier statement just to help put the nail in the coffin ) However, the driver is subject to whatever state laws they may be driving thru.
What drivers are aware of, or should be, is that LEOs do not need a warrant or probable cause to stop and inspect a commercial rig. Commercial rigs are treated differently than Joe Citizen cruising down the road in his Dodge Dart. An MCS officer can stop commercial rigs at random and conduct an MCS inspection which includes the contents of the cab. If a firearm is in view and is being transported in violation of state/local laws then the driver can be charged."Last edited: Apr 30, 2011

I have very successfully and legally carried a firearm in my truck for years. If you are willing to spend a little time there are resources out there that will tell you what you need to to do carry in your truck. handgunlaw.us is a great resource. There is no state where it is illegal to transport a firearm, there may be specific ways you need to do it but it can be done.
There is no such thing as a fccw, they are state issued. My permit happens to be good in 33 states. I very rarely go to the ones where it is of no use. -
OK so you go from the "protection" of the firearms transportation act to carring a conceled weapon in a state that may not allow it! GEEZ that's a good move.
Since when would the company that owns the truck need a warrant to search it? DOT may but then again may not depends on who ya talk to. -
Your right , you are wrong!
No laws against a firearm in a CMV, you also allowed to transport a firearm BUT as soon as you pick it up it ceases to be in transport and becomes possesion.
-
I will have to go back and read my posts cuz I don't know what you are talking about.
Im sorry, you misunderstood me. I would never leave a firearm in a vehicle that is not in my custody. So, if it is going into the shop, my firearm would be removed. If I am away from my truck for hometime, my firearm will be removed. The only time I would leave a firearm in the truck while I am not in it is if it will be for a short period of time like at a truck stop and I cannot carry it legally and the truck is locked with the keys in my pocket. It will be in a handgun vault bolted to the truck. -
And put it where?
On your person?
What if somebody notices it?
The company will not allow firearms on their premises and if caught, you will be fired and escorted from company property.
Then good luck finding another trucking job.
How are you going to bolt a vault to a company vehicle? -
actually there is or at least use to be. one can apply for a federal carry permit once one has in their possesion a ccw from their home state and 2 other neighbouring states (good luck if live in mass. ny dc, md and nj).
-
Nope, there is no FCCW. The only thing that even comes close to that is a law that allows retired peace officers to carry in all 50 states. There are stipulations to that. They have to have at least 15 years experience and have a full retirement from their city or state. They must also have qualified with their weapon in the last 12 months. There is no license or permit issued for this.
