Carying a tent in a daycab, line 2 or line 1?

    Thanks for bringing this back around. It's too bad there has to be a "fear factor" of what some officer might "demand," when you are within HOS regs, and just enjoying personal freedoms.

    Big John,

    You can't be off duty resting in a day cab (or put another way, if you are in the cab your clock is running). You can be off duty not working away from your day cab, driving, or on duty not driving. You can only log sleeper berth time if there is a sleeper.
    If you have a day cab you go to the motel or bring a tent.

    Certainly the driver can be asked those questions and be expected to provide either proof, such as a motel receipt (if the driver is claiming to have slept in one), or a reasonable answer, such as, "I stayed at my cousin's house" or "I slept in my tent, under the stars." As I stated in an earlier post, the issue of proof only arises if such proof exists, i.e., there is a receipt from a hotel, toll booth, scale, fuel, etc. There is no requirement to produce proof if it does not exist, eg., if a driver fuels at a company terminal from a pump that does not generate a receipt.

    Under the current regulations, a driver cannot log OFF-DUTY in the cab. A driver can only log on lines 2, 3 or 4 as appropriate. That is something that would change in the proposed HOS.

    You got a cell phone camera? Or a real camera with a time stamp? Take a picture.

    Otherwise set the tent up on top of the cab, lol.

    Better yet, stop being a tight wad and enjoy the motel. :)

    I have been doing an overnight route in a daycab for three years, had several DOT inspection and have never been asked to prove where I stayed off duty. Where I stay is not thier business.
