International truck single axle running 26,000lb plates with a 2200 gallon tank mounted on it. Guy is telling me he has employees running this truck with a regular operators license and only a physical on file with his company. No tank endorsement nor CDL period. Can someone tell me for sure and find where its at in the regs as I can't find it anywhere on the web. I have argued with the guy and now what to prove to him what the regs state. Thanks....

The Commercial Motor Vehicle Safety Act of 1986 was signed into law on October 27, 1986. The primary intent of the Act was to improve highway safety by ensuring that truck drivers and drivers of tractor trailers and buses are qualified to drive Commercial Motor Vehicles (CMVs), and to remove drivers that are unsafe and unqualified from the highways. i worked at a tire shop that had bigger crane trucks for off road tires. like on the big bucket trucks and rock haulers. they too had a truck plated at 26,000lbs and did not require a cdl. they required a physical card and any applical endorusements.

your fine on the weight at 26000 but i think your over on gals for needing a tank endorsement, ill see if i can find the reg quick and post back

He hasn't weighed the truck while loaded yet but he is using 26,000 pound plates. He had his guys get physicals and he keeps them in a file in his office in case he needs them. They are not sent in to the state. I believe with this having a 2200 gallon tank on it the driver would need to have a tank endorsement. None of his drivers have this as the owner doesn't believe they have too. I am personally taking his truck loaded over to a grain elevator tomarrow to weigh and see just what she weighs.

and from what i have found in a few minutes each state has its own requirements on who needs a cdl and for what. so stop in at your local DMV and get a current CDL book. it will have the requirements per your state

A driver licensed in New Jersey must have a CDL to drive legally a bus, limousine, or van that is used for hire, and designed to transport 8 to 15 passengers.[SUP][6][/SUP] A driver licensed in New York must have a CDL to legally transport passengers in school buses and other vehicles listed in Article 19-A of the state's Vehicle and Traffic Law.[SUP][7][/SUP] A driver licensed in California must have a CDL if his primary employment is driving, whether or not you actually drive a commercial vehicle. Tank vehicle means any commercial motor vehicle that is designed to transport any liquid or gaseous materials within a tank or tanks having an individual rated capacity of more than 119 gallons and an aggregate rated capacity of 1,000 gallons or more that is either permanently or temporarily attached to the vehicle or the chassis. A commercial motor vehicle transporting an empty storage container tank, not designed for transportation, with a rated capacity of 1,000 gallons or more that is temporarily attached to a flatbed trailer is not considered a tank vehicle.

so a permently mounted tank more than 1000 gallons is a tank vehicle and therefore requires a tanker endorsement.
as far as weight as long as its 26000 and not 26001 you do not need a cdl, just hope they don't get pulled in at 1lb over your registered weight or they will get hit for driving without a cdl.volvodriver01 Thanks this. -
