States are really cracking down on this behavior. My last job said anybody who gets a ticket (1st offense) for texting or talking on their cell while driving is immediately terminated. Reason being that the company insurance demands it. They don't mess around. It can be career ending, so don't do it.

Texting is a termination offense with me by the way.
I had one driver who was caught by the cops and he could not say he wasn't on the phone when the cop seen him because he was on video from another of my drivers who passed him while he was texting, the camera caught him actually texting.

if it's specific to truckers, then truckers gotta be using bluetooth to stave off tickets, fines, etc.
my state will start the new law in June, regarding ALL drivers on cell phones....get zapped. -
My local town issues tickets that don't get recorded as a violation on mvr.
Unless it's a moving violation.
What form was used to write the ticket.
I've seen phone violations as high as $10,000+ for company and $2,000+ for driver. Company fines given after driver is found guilty.
John should hire an attorney and try to resolve before court date.
