The whole ambulance chaser idea of wrong place wrong time sucks.
In extreme cases where the driver could really be fatigued then sure. But 15 min over is nothing. But it is enough they can say you should not have been there and they have some odd idea that the ppl would not have hit the truck if it had not been there, and they would be alive.
Most likely they would have hit someone anyway. But if it was another 4 wheeler then there may have been more deaths.
But since it is a truck they don't care about fault, they just want money.
This is not about the dead people. This is about making money.
I hope the driver gets thru this well. The fact he is over is one thing, at least he was not lying on it. Catching you over is nowhere near as bad as catching you lying and over.
That will get you in prison in some states since lying on your log is a felony. Not having one is a misdemeanor.

I dont think that a driver being where he should not be at any point in time should change who is at fault, and honesly I think I could eather win the case if it was me or at least get the liability so low that it would not be much.
Most drivers do not go over like that on there e-logs. So something caused him to do so. He may have been using the safe harbor time or whatever. Who knows.
He is going thru enough right now though without having some idiot coming after him because the idiots wife ran her car into him. Hell she was possibly commiting suicide.
The only thing the driver really did wrong, if he did it, was talking on his phone. That is not a good thing to do while driving even with a headset.
