While I do agree that we are in an era of increasing government regulation, I don't think you can provide an example of regulation that would be similar to the government regulating detention time or FSC. It is your right to choose how to charge someone. For example, let's say a shipper always takes 4 hours to load a truck, but refuses to pay attention. You might choose to do business with them, but increase their rate per mile by some number to make up for the lenghty loading time. You don't have to fight the shipper for detention pay, and they are unaware that they are actually paying it. You would be surprised the inefficiencies that are hidden in our industry in this manner. As I said earlier, most trucking companies are too intimidated by their customer to tell them they are paying 10% more per mile because they load truck slowly.

There has to be a limit as to how much one can legally drive...I think that's common sense. How much? Very, very debatable. Doesn't matter how the regs are set up, someone or some group will not like it.
From a completely and totally personal perspective, since being on CPAP for my sleep apnea, I wouldn't have any issue with driving a few more hours a day from time to time (more than the legal 11). And I sure would have NO trouble working more than 70 hours. Some days are better than others. I wouldn't have said that during my first 8 years of driving.
But there has to be a limit, or we all know that companies would push and push and push....

It is exactly what happened. Had an issue with my dispatcher to the point I was brought in for a "discussion". After going around in circles for a few minutes, I told him I have been doing this on n off for 15yrs and I have a spotless record for a reason, I say when the truck moves and when I need rest. He proceeds to say "I would never tell you to do something illegal or unsafe but having said that you need to do what needs to be done". I said ok and I will still stop when I say, I refuse to drive off the road for anybody. They didn't like it and the rest is history. I guess Im supposed to feel priviliged they "gave" me a layoff. F'em, I'll find something.

The problem is, regardless of regulations, people are different...Like sex, some can go shorter periods of time, some longer and that may change from the many variables we all face every day...Running someone over killing them, and you're 100% at fault, after 10.5hrs of driving or at 11.5 won't change things much...

You might start by finding a lawyer. I understand we have a pretty good one on these forums, unless he's been flamed out. Would be a bummer if he was. He is actually ineresting to debate.
