To clarify, it's based on the difference in income between both parents.

Most states set a base amount that's needed to care for the child. Then they take into account the income of both the custodial and non-custodial parent. Then they assign a percentage of that base amount to each party, based on the difference in their incomes.

For the record, I don't think that is the correct way to do things, as it benefits the custodial parent unfairly.

My belief is that BOTH parents must make a monthly cash payment into an escrow account to support the child. Then disbursements from that account would be made for the benefit of the child ONLY. Documentation of expenses must be provided to receive payment from the account. That's the only fair way to do it. Anything else would unfairly burden one parent or the other.

Too many gold-digging single mothers out there.

If you do get called back in for a modification, it's worthwhile to lawyer up.
Might cost you a 1000-1500 for a day, but they will be able to argue the expenses of being a driver and request that the child support be based on income over the past 5 years compared to only current earnings.

windsmith, Dharok and David Bistram Thank this.

A female attorney that's pro-father's rights is priceless.
