Child Support ?

    I asked this in a thread about per diem in Stevens section but looking for a quicker answer. Does per diem count as income in regards to child support? Now don't get me wrong I am all for paying proper child support but I have been getting raped the last few years since I lost my decent paying job in '09, I went from 40k a year to around 20 after a year in a half of unemployment did they lower my amount to be paid upon request.... no they didn't they basically told me to find a better job and kept right on charging me the inflated rate. So now I'm a little jaded and have a bad case of the #### you's . Anyways long story short I owe back time which there charging me more for per week, and as soon as my ex finds out I have a better paying job its back to court I go. So hence the ? -Mondo

    Can't answer your question on per diem but can sympathize and support. Been there done that. She got 55% of my income and when I lost that job due to consolidation of operations the court could care less. They only looked at what my 'potential' for earning was and the judge told me to find similar and appropriate work to continue to 'support her in the manner to which she was accustomed'. Never mind the jobs at that level in that industry were being eliminated.

    Funny how how it's supposed to be 'child' support but then I get told to 'earn to my potential' to 'support her' in the manner to which 'she' was accustomed.

    I wouldn't think per diem would be figured in considering it isn't figured in so many other areas of finance. I wouldn't know for sure though considering I made my last payment to her years ago.

    Good of luck to you and good for you for not trying to duck the payments as so many do.

    DO YOU CARE ABOUT YOUR CHILD? If so, who cares how much you need to pay. Be a good father and step up to the plate. Your kid should be worth it. The important part is providing your child with whatever they need, not what the government says they need.

    Yes Per diem is income, and don't think you have made it to the big time. Now that you have or will be getting a cdl. The numbers look big but that's because of the amount of hours you work. They might even feel sorry for you and give you a reduction in child support. When they see your rookie checks.

    This is incorrect.per diem is not considered income. You need an attorney not a board full of ( well meaning, but still truck drivers ). Part of the problem of per diem is it makes it more difficult in most ways such as credit, buying homes,etc...for instance per diem is not on your w2

    otr truck drivers always has to pay child support because they have a girlfriend in every city nd if i was a judge i would make sure i charge yall double because yall make good money enough nd not taking care of your child lol smh.

    I could be completely wrong, but isn't per diem used as a deduction on your income tax? If it is a deduction, how can it be income?

    The court see's at as income. It's just not taxed.

    You need a lawyer, it is not income.I have 2 daughters different muothers, different courts different states even. California and Tennessee.neither counted my per diem pay as income.per diem legally reimbursement of cost of living. Both family courts saw it that way. You need to consult an attorney in the state dealing with the custody financial issues.
