Citation for possession of alcohol while operating a CMV...

    Agree, no moral harm done.
    But not in a truck.
    The problem is the regulations are a result of bad behavior and there is a problem for people who don't want to abide by the regulations. This one won't be changed and will continue no matter what but others should be which are really nonsensical in both nature and reasoning.

    Why are so many posters mentioning SAP?
    Possession of unmanifested Alcohol has nothing to do with the substance abuse professional treatment system...

    For me, even though I dont drink, it’s not so much that you had a few beers in your bunk during a reset.

    Don’t get too wasted, clean up, get a good sleep etc… no harm no foul in my view. Key word there is “no harm”.

    But you were driving a semi with a 12 pack in plain sight for an officer to see ???

    That is probably the stupidest thing I’ve ever read on here.

    80% of the population between I-35 and I-65 has a drinking problem if a one off 12 pack in a day and a half is the qualifier lol.

    It’s a tolerance thing as much as anything. Even if you’ve been a former drinker and you’ve quit for years, the tolerance will stay with you. I remember the very first couple times I had a beer as a young lad. I felt the same buzz. I probably would feel with a six pack today. Although I don’t drink anymore. I did through my 20s and 30s although I was always responsible with it.
    As for the original poster, the rule is simple and it’s very straightforward …no alcohol in a commercial vehicle. Doesn’t matter if you were driving or not you had alcohol and half of them were open containers because you had already drank them. And on top of that, you left them sitting out in plain site. The officer standing on your step could see them. And then he probably saw some of them were empty. He had no choice, but to write a citation. And after that, your company had no choice but to fire you.

    Does Kentucky have an open container law? Tejas does. An open and or empty container in cab or passenger compartment of any vehicle basically equates to dwi.

    I worked for a company that had a strict ‘no alcohol’ in any company vehicle at any time. That company actually had a policy of ‘no alcohol in your possession while in uniform’. Those rules applied to all employees, and all company vehicles, salespeople’s cars, supervisors company pickups, everything. There was a crew manager that was observed shopping at a local grocery store, while in uniform, loading his groceries into his issued company truck, in the shopping cart was a couple cases of beer. Next morning that guy was called into the service center manager’s office, and terminated. This company also had a ‘good behavior policy’ for all employees. Proper conduct’ was expected at all times, even on your personal time. No stopping off at ‘Rick’s Cafe’ or ‘Jaguars’ on your way home with a company vehicle, or wearing company uniform. No patronizing book stores, massage parlors, gentleman’s clubs, whorehouses, etc. with company vehicle.

    Well, the second stupidest thing, after one of Hey-SOOS 1337's posts....

    Quick and easy way to remember that!

    EVERY state has an open container law; about 30 years ago, it was a pre-requisite for any state to continue receiving federal highway funds. States like Florida, Texas and Montana had to close down their drive-thru bars (don't laugh, they DID exist once...) made a big stink about that, but the other 90% of us just laughed that such things still existed there....
