Arrived at this place to pick-up a load that was brokered to my carrier I am leased to. Was there a few minutes prior to my "appointment" time. Was told to drop the trailer on their trailer lot and LEAVE the property, that they would call me when trailer was loaded. About 9 hours later it was done, but I didn't go pick it up until my 10 hour break was done. Wasn't paid a single penny for detention. I moved that load to Clopay in Farmers Branch, TX, and had a 3.5 hour wait for them to unload it by hand. It was loaded and unloaded by hand, a bunch of garage door panels and parts. Worst shipper/receiver I have ever been to in my life. Cheapest, too!

Sounds like your issue is your carrier not Clopay. Did you get paid by Clopay or your carrier, if by your carrier, then that is who cheated you out of money

Good Morning,
My name is Tyler Rutter and i was an employee with clopay in January and February of this year. When I applied and accepted the position I was told I would be operating a standard sit down forklift, which I have many years of experience with and that was completely acceptable. Upon completing the hiring process and before orientation I verified this information with the training employees and informed them that I wanted to make sure this was correct because I have a birth defect/ disability called klippel feil syndrome that limits the range of motion in my neck and back. I was assured this information was correct and began orientation as advised. At the end of the orientation week I was then informed that I would be operating a much larger machine called a drexel, which requires the user to use a joystick at all times, limiting the driver on how they can rotate their back to see their surroundings. I informed my manager that this would not be safe for me to operate because of my limited range of motion and I was informed to go ahead and give it a try and that he would work with safety to see if there were any other options. I did as instructed and after about 2 days I again informed my manager that the required body mechanics to operate this machine was causing my great pain and that it was impossible for me to see behind me as I could not rotate my head or neck. He then informed me to suck it up and figure it out. At this point I decided I would go back and talk to the health and safety people and inform them of the situation myself. I did as such and was told to continue doing my position and they would also look into it and get back to me. After another week goes by with no information and dealing with extreme pain in my back I return to my manager and tell him and he gives me an afternoon off to relax my back. The following day when i returned he put me back on the same machine that was causing the pain. i put up with pain for a few more days until i was loading something in a rack, and due to my inability to turn around, i have an accident and knock over a bunch of product. i follow protocol, inform all proper management, submit to and pass drug screen, and go through recertification. At this point i have now informed 5 people that i can not safely operate this machine, and yet again i am forced onto it with care that not only am i hurting my back, i'm also putting others in danger as i can not safely see around the machine. 2 days later, I'm coming around a blind corner, and again due to my inability to move and see, i come around and knock over an entire control panel, ripping it out of the concrete and destroying a fence. I inform all appropriate people, take my drug test, and am stuck BACK ON THE SAME MACHINE!
At this point i'm irate that no one is listening to me. i finish out the day and go home, and when i awaken the next morning my neck and upper back are extremely sore. Upon arriving to work i go to HR and inform them of the injury and they instruct me to see CLOPAY CARES. I do as they ask and i inform the DR. of my neck abnormalities and that its unstable, and instead of ordering any imaging or even examining me, she just says my body is not fit for my current position. In short, shes just reiterating what i have been telling these people for 2 weeks.. Now that i have this information from their doctors i return to HR and they inform me that they have no position for me now and fire me. In a matter of 2 weeks i informed 5 individuals in a management and safety position that i can not perform this safely, they force me to do it and i get injured, and then when their dr finally tells them what ive been telling them all along, they don't even look for another position they just fire me. This is clear and blatant discrimination against a person with a documented disability. Even after being let go, i attempted to see a dr for the pain i was still having, only to find out they didn't file the injury paperwork for another 4 MONTHS! i was unable to get any care for 4 months due to their negligence. Since the release from the position i've been working on collecting information, speaking with and obtaining my rights from the Equal Employment Opportunities Commision, and gathering evidence.
My purpose in writing this is to inform you of the kind of company you are working for, and if any of you have any similar situations and have questions on what to do, or would like to provide your statement to show a reputation for this kind of behavior your can email me.I cant provide you legal advice, but i can guide you through the process and hopefully get justice for all the wrongdoings committed by Clopay.

Said to these situations take place. Why didn't the carrier get the detention details ironed out in writing before accepting the load?
