The judge may well enforce it if he finds the reason for firing him satisfactory, this one is questionable at best, if we are getting the whole story, might just backfire on crst. Has the OP even said it was crst, or is that just a guess?

I believe it was @Chinatown 's educated guess; not sure if the O/P confirmed or denied. He's not been back...what's that tell ya.

Once fired the contract is null and void.

He didn't say who he worked for.
    Hopefully they go bankrupt soon!

Nope. Once fired the portion of the contract that deal with getting released with cause (firing) is triggered. Part of that portion of the contract states all monies due is owed.

I would sue for wrongful dismissal.
Can't fire a driver because of some other adult drivers actions.
That would be like me firing Warren because Keith hit a tree.

Of course not. The general CRST contract has been posted here before and I've read it. Even if it's changed or even not CRST, there is no corporate lawyer that would let a contract without a firing clause get used.

Now that might be a way to fight it. But realize it would be a court case and not an automatic win.

I've got one of them letters too, not word for word but close enough. it was sent to me, directly, after someone applied for a position I had open that was not a driving position but office position.

My lawyer sent a really nasty letter back telling them to stick it up their **** because a company has no power to stop use from hiring anyone when we didn't solicit the person.

Dale thompson and G13Tomcat Thank this.
