There will be no problem, the person being hired isn't the competitor, the company is and the company didn't sign them on-compete. The driver unless they take customers or trade secrets, have no worries, I don't think any non-compete has had a driver ruled against in court.
This thing about pouching drivers really should be addressed by the fmcsa, there really is a case where contract for training and repayment should not be tied to any expectation of employing the person if the person has better opertunuties.
