    The angle of the impact if there's a collision is also a good indicator, such as if a truck's fender met a car's rear quarter.

    I have a feeling that once the investigations are complete we'll discover that HOS, Walmart, and/or time without sleep was not really a factor at all ... can you say "driver distraction"? We see these rear-end crashes all the time lately at the back of slowed or stopped traffic on interstates. It would be hard to imagine all [or many of these] were due to driver fatigue. It just doesn't compute and I suspect the driver, shaken, distraught, in shock, etc, thought a "no sleep" excuse would sound better initially, then admitting guilt up-front to texting or web surfing while driving. We'll see.

    Although I will admit the time of the crash does lend credence to the excuse given, particularly if he was nearing the end of his 11/14, but I'm still wary of the claim and would be looking at smartphone activity.

    Personally I've stayed up for more than 30 hours without illegal drugs...now we have energy shots, pills, drinks, etc. Wednesday morning I woke up at 7:30am in Harvey, IL at our terminal to get my truck worked on. Left Harvey, IL around 3pm and headed to Seneca, IL to pickup load. Left Seneca, IL around 7pm. Got to Love's fuel stop in Conneaut, PA around 2am ate fueled and relaxed for about an hour. Stopped for the night in Angola, NY around 6am....this was right at 24 hours before I actually went to sleep

    They have given me no reason too doubt them before. And I explained to them I was not trucking anymore without it.

    Just had a thought, they claim "he was awake for more than 24 hrs straight" and then in the next sentence "he was asleep at the wheel when rear ending the limo".

    So which one was it? If he was asleep at the wheel when the accident happened then technically he was awake for 0hrs straight when the accident happened.

    Still wrong though, because the law is awake 24 hours straight before driving. Falling asleep behind the wheel is irrelevant (but kinda the point).

    The best kind of smart aleck is the one that's detail oriented.
