Company Called DOT on Me- If I pay citation am I admitting guilt?

    I accidentally logged 10 Hours and 3 Min during my sleeper berth/off duty time as on duty. I then began driving, this was the last day of a 1600 Mile load and only had to drive 88 miles.
    A NEW dispatcher at my company freaked out and saw that I was "in violation". He texted and called me several times and told me to stop driving. I didn't because I only had to drive 88 Miles to finish delivering the load and if you don't deliver the load the company does not pay you for the miles you drove (the previous 1522 miles), because yeah the company is a douche. If it wasn't for that I would have just stopped driving or turned around and brought their truck back to their DC because I was about to quit anyway and this was my last load.

    Well my company called highway patrol on me. Got pulled over 10 miles away from the destination and was issued a citation for being in excess of 14 hours.
    I told them that my ELD was erroneous and I was driving under 150 miles so didn't need a log anyway but he did not allow me to edit my log.
    As of today I was now able to edit the log and change that 10 hrs 3 min of on duty time to off duty to accurately reflect it. Can I just show the court the printout of my edited log and say "look theres no violation"? Case dismissed. My ELD also wasn't properly syncronized with the truck so maybe that helps me. So I could argue there's an ELD error.

    Literally could've just done the load at night when the dispatchers and office people are at home and none of this would've happened. It was literally my last day anyway. Just wanted to deliver the load to get paid for the previous 2.5/3 days driving. Now I get $0 anyway plus a citation. #### trucking.

    Do you drive for a 1099 company?
    I've never heard of a legit company doing something like that.

    Well ..... you got the citation and at the time of infraction you were in the wrong .
    Editing or correcting is after the fact .
    ( ie - 25 miles from house , out of legal hours , i went off duty and drove home.)
    End result was getting fired , but i too was quitting so that was it .
    Yours is that you got a ticket / citation and now that will hound you for awhile.
    PSP , and whatever the company says about you later .
    Best recourse maybe is to lawyer up , take any log records you have - like on a app - and plead your case.

    Your 150 mile understanding is incorrect. You can't just not log because you have not yet exceeded 150 miles from where you started.

    No cop is going to take a driver's word that his ELD is wrong roadside. Maybe you can get the violation removed from your PSP by DataQ.

    Nope it's not 1099 it's w2. Never heard of a company calling DOT on their own driver you mean?

    What I'm getting at is refusing to pay a driver for work that has been done, such as your miles on that long trip.

    They can hold your pay for 45 days....but they have to pay you.

    I really don’t want to sound like an A Hole or anything, BUT you acted like a moron. You had your 10 in, All you had to do was just pull over and edit. Doesn’t matter if you were quitting, doesn’t matter if this were your last load…all of that stuff you posted is irrelevant. Simple fix. When the dispatch called, hit the shoulder and edit. Easy peas. You chose to be a jack5ss.

    If your CDL actually does matter to you then drive accordingly.
