Contract examples for 1099 drivers

    #1 You wanted to direct a message to them 3 PM them. This is a Know it all (LOL) Drivers website and weather you believe it or not your going to read replies you may or may not like. I agree with RM. Contact IRS ask the main ones running the show. Insurance,IRS,Government and your Driver Manager or Dispatcher. We only know it all on how to work the rules in our favor. Cheating as some may call it. :)

    RoadMedic I say the same thing you do, I don't believe it is legal in the setting of a driver works for the owner of the truck and the company, this right here abolishes the Employer/I/C contract as it is written in the IRS Code, End of Story, don't get bit doing it any other way. Get loads that have the taxes all the other fees and a good percentage or CPM's for the driver and stop looking over your shoulder, by the way the IRS agents are not going to look funny or have any different look then anyone else till they show up and show their ID and then your imagination will make them look bigger or more then they are but then they will be justified is when they tell you they are in the right about the 1099 employee status and now they "Are seizing your assets to a tune of 50% of your GROSS Income the past three years averaged!" Then you know you have screwed up and away goes your stuff till you can buy it back. END OF STORY, There are no Contracts to sign to make it OK unless the I/C owns and operates the equipment and can pick and choose their own loads either from your loads or from ones they find it is not a 1099 deal.

    If you noticed my question. It didn't ask for your opinion on having and ic driver. Your opinion is just that and i am we'll aware of it. I didn't stats any specifics, you don't know if he owns the equipment. You just jump to conclusions. That's why a lot of these post don't get anywhere because the same people want to put there 2 cents on get off topic. Stop assuming and move around.

    I understand that everyone has there own opinion but if you are not answering the question that is posted then don't reply and get the the post off of the topic. It is not about whether 1099 is legal or not. Who is right or wrong but asking about examples of contracts.

    The average working person, truck driver included, is far better off receiving W-2 forms vs. 1099 forms.

    The average working person needs to have their income taxes, social security taxes, and Medicare taxes paid into the system. Also, the average working person needs to have the employer contributions of social security, Medicare, and workman's compensation paid into the system.

    Also, there are concerns involving medical, dental, 401(K) & retirement plans.

    By far, W-2 forms are the way to go. 1099's favor the employer more than they favor the employee. If the employee gets injured, sick, or put out of commission, it could seriously affect his or her medical, social security, workman's compensation, and disability pay.

    It is illegal, there should NOT be any contract that is ever written, It is what it is, Why don't you just shake the drivers hand? That is about all it is worth, You will pay him for his services but what you are doing is illegal. End of Story.

    Someone answer the question why you don't see a company lets say over 20 drivers doing a 1099? Every single one of them are small outfits. There is a reason for this. It's kind of like parking by the CatScale. Because they seen someone else do it. That doesn't make it right.

    About the only way you can do it is lease to own the truck. Then make him sit the month before he has it paid off. Just like the big companies do it! :)
