When did you sign up with them? The contract I signed with them was from October 2013. If Iread your post correctly you signed the contract Jan 2014.

Correct but no where does it state what you said in mine. What I uploaded is the only part that keeps me from working somewhere else and they cannot do it forever. That's why the restrictive term is the remainder of the term.

Ok, I just read your contract and yes, it is way different than mine was.

After reading just the little bit you posted of your contract, the non-competition restrictive covanent states that you can't work anyone else in the truck driving industry until you either complete your 8 months of employment or until you pay back in full what is due according to section 7. (this can be found in paragraph 5.b: "restrictive term").

So it's pretty clear to me that you can't work for anyone else in this industry and yes that would include even the local gig you have now, until you pay CRST back what is owed to them as stated in section 7 of your contract. That is how and why they keep sending those letters to everyone you have applied to.

How much does section 7 state you owe?

So you're going to need to find a way to come up with that kind of money or see if they'll let you go back and finish out your contract. How much time did you have left before your license was revoked? Why was your licnese revoked? Sounds to me you either need to start delivery a lot of pizzas or selling stuff off to come up with the money.

A revoked license. A revoked CDL?!

The STATE Revokes. Not CRST. You have not indicated you have been caught, run down, corralled or arrested and charged with a serious vehiclar violation either personal car or big truck or even run down for failure to pay child support or even student loans. Sometimes Licenses can be taken away from a Professional as part of collections action.

You are not going to be trucking on that revoked CDL. In fact obviously you will be taking a bus, walking, riding a bike etc.

    Now.

You incurred the 4000 dollars for the schooling. You need to make CRST whole on that money. Everything else up to that point is over and done. You would probably have been better off getting a student loan to pay the school. That was what I did. Paid 50 a month for a few years until I finished them off in full. Did the same thing with college loans which was about 40K for myself and wife.

Wife went to school on FFE tuition. 3000 dollars, 1800 turned out to be outstanding and we had a credit card big enough to pay the school that 1800 and eventually paid the card off easy.

If you have a good fico score and can generate 4000 dollars in a line of credit you can transfer and pay off CRST.

As far as Collections activity, google your state laws that have very specific restrictions on what collectors can, cannot do, can say to you, cannot say to you etc. Once you understand that, you can protect yourself by sending collectors specific short one page letters not to contact you within the frame work of your particular state.

If they wish they can take you to court and obtain a judgement against you. If you show that you are BK, be very careful with that. 4000 dollars is not like say a 150,000 trauma medical billing on 10K income per year after a bad wreck. You can only do BK personal once in life time.

I don't do contracts with carriers as afar as training, schools things of that kind. There is usually a gotcha and you might discover beyond DAC, PSP etc there is also a blacklist against you in name so you can forget about trucking for a long time.

Im not here to give you a hard time. I myself have felt the challenges in my own situation with trucking and that with the wife when she got her CDL.

Unfortunately under the DAC guidelines that Im going to post that I usually post with a link to help point you to researching DAC violations for truckers personally, a revocation appears to put you out of the trucking industry for a minimum of 10 years if not outright life.

There is a work around provided you can get that CDL restored to you from the State. You can run for a local employer who does not have a DAC in sight. However... the United States Government is moving to corrall ALL CDL and ALL Employers under a umbrella by this Xmas period in which NO one will be able to bypass DAC by say joining a dumptruck local employer without any checks at all other than MVR Record.

Ive retired. But Ive have learned recently that laws are being made very quickly to reduce our freedoms in being employablity that I think supports the increasing number of Immigrants taking our jobs for half or 1/3 what we would command on the pay scale.

Anyway.. These are my thoughts. I find it really incredibly hard to bear to see you endure these things with trucking contracts and so on.. and it hoped that it will motivate you to advocate for others who are new and are thinking about signing away the tuition costs of trucking school in form of a contract too.

A long time ago, major trucking companies were training upwards of half a million newbies fresh out of school at 21 years old. No contracts then just complete your trainer time without being a bad boy. And lots of these people were able to leave the major carrier that trained them (Quit) and go to a better carrier with better equiptment etc.

It was not too long after that got stopped. That was then the rise of the trucking school.

What would I suggest for trucking school learning is literally a State College with federal loans. You get a grace of 6 months and a certain amount of money due each month. The problem with these is that they are not dischargeable at all. Even if you DIED, your kin listed in the estate will still have to satisfy Uncle Sam.

I may be wrong on that last point. As of today there is 1.3 trillion in Student loans on about 40 million students more or less. 40% of whom are in default of some kind already. We paid our 40K off by selling a house. No problem. Once that was paid we are free from Uncle Sam.

Here is the DAC link for information in general and significant cases in Justice for Truckers.

You may be able to find more information with them and similar organizations.

    http://www.truckersjusticecenter.com/significant-cases/

Here is source specifically about trying to get hired and some of the things that will essentially BAR you either a period of time up to including years and for a few such as a felony a life time ban on you being hired to truck.

    Source Link.

Q : I have used many services to look for a driving job but I'm having no luck at all. What would keep me from finding a truck driving job?

If you are having more difficulties than normal, there may be something in your driving record, MVR or DAC that is holding you back. The following are examples of items that might keep a company from contacting you for employment:

1 or more felonies in your lifetime
    A drug related felony conviction
10 years or older felony conviction
    Child pornography related conviction
    Convicted of a violent crime
    Firearm related conviction
Murder / Rape / Misconduct / Burglary / Robbery / Capital Theft conviction
    Assault & Battery
Conviction/ investigated / or suspected of involvement in of terrorist activities
    Currently on probation or parole
More than $5,000 of damage from a preventable accident in last 5 years
3 or more moving violations in last 3 yrs
3 or more preventable accidents in last 5 years
Truck abandonment in last 5 years
License suspension is less than 3 years old
1 or more moving violations over 15 mph in last 3 years
A DUI/DWI within the last 5 years or more than 2 DUI/DWIs ever.
Fired in the last 5 years
    Ever failed a drug screen

This is the way I read it:
That tells me if you quit or are otherwise not employed by CRST prior to the expiration of 8 months of continuous employment, they can come after you for any monies owed, including the attorney and collection fees.

The very next sentence says this:
That tells me they can also go after the local company who you have been working for for the last year. My guess is that is the clause in the contract they used to go after and win against JB Hunt.

Additionally, there is nothing in the part of the contract you posted that defines when the contract will expire, other than the fulfillment of 8 continuous months of employment or repayment of expenses incurred, so yes, in reference to your post #23, CRST can continue to enforce this forever until you fulfill the requirements, as per the contract you posted.

With the contract stating 8 months of continuous employment, it wouldn't surprise me if, should you choose to go back to CRST to finish out your contract, they make you do a brand new 8 months, not just whatever was remaining on your initial contract. Should you have left at month 7, you would think you would only have to suffer and endure their employment for 1 month, but the term "continuous" means "unbroken, without interruption" and leaving at the beginning of month 7, then coming back for 1 month would not be 8 months unbroken, or without interruption.

I encourage you to seek legal counsel on this, as this is only my simple take on the matter.
