Could it have been the Beemer driver's fault?

    I was driving home from work this morning on the SB side and took a gander as I passed. It made me wonder how they could make this the fault of the trucker with no apparent damage to his truck but what seemed like a car body part stuck to his left-side trailer door.

    But as I type this, I realize that it could have occurred as he was making a lane change.

    Call me biased, but I think I the professional driver is not really at fault here. Doesn't mean the truck driver won't be blamed though...

    I believe it's pretty cut and clear it isn't the truck drivers fault but what do I know. That much damage that BMW was flat out flying or the truck was nearly stopped.

    Could it have slid under the trailer on the side we can't see?

    Not much info to go on but it looks like the truck was stopped on the shoulder. Initial impact was at the back of the trailer. Hit a large non moving object and I figure you're to blame.

    Looks to me like the truck may have already been stopped on the shoulder at the time of Impact

    I can't open links with my smart phone so I can't read the article. Just remember one very important thing. If you park on the side of the road like that with no triangles out your taking a serious risk. Liability is not that easy to determine.

    I wad finally able to open the article. I don't see anywhere in it any mention of blame. Actually all that article did was tell of an accident and traffic backups because of it.
