(warning sarcasm alert)
You know maybe I'm wrong and everyone else is right!
Maybe CSA 2010 is going to be a good thing!
Maybe EOGRs are going to help me!
I mean how many other "safety" initiatives have helped me in the past. I know that NONE of them have been bent, twisted, curved, or warped to be used against me ever before!
Let's see: logbooks, FMSCA regs, seatbelt laws, weight limits, truck inspections, local cops allowed to be DOT certified,... yep, NONE OF THOSE HAVE BEEN USED TO HURT ME OR TAKE MONEY FROM ME!!!
The Safety people only want me to be safe, they dont want my money! The LEO can be my friend, not an over-zealous tax collector with authority to take away your rights without due process! I've never been abused before in the name of "Safety". I must be paranoid to think it might happen now!
Did I make my point???

Dave, I realize what you are saying. Trust me, I do. I hae worked as an assistant in Safety, I am a driver's wife, and I have done a little dispatch work. So I see all sides to this. At this time, there is little to nothing to be done about it, except learn to work with it.
Right now, I am not too worried about it, as my husband works for a company now who DOES fix things with the FIRST complaint. The owner was a driver and trusts his drivers completely. So for us, it is a non-issue...
For those of you who's companies DO NOT care, we need to find working solutions...
For example, an appeals process for those who have violations that the comapny refused to take care of.. or whistleblower protection for those who pull in into the scalehouse deliberately looking for help. And some kind of compensation for those who get canned for refusing to operate crappy equipment....RickG Thanks this. -
Meanwhile the cars continue to run 80mph on every major highway with the cops doing nothing. I see it every day. In fact I have a little more video of it every day. I think if I compile enough of that, especially the ones where they do stupid, illegal stuff right in front of a cop and the cop ignores them to pull over a truck that wasn't doing anything at all, the media will shred these jerks. That, I will find funny.

I can attest violations are investigated and when the case can be proven enforcement action is taken against the carrier:
http://ai.volpe.dot.gov/SafeStat/CarrierOverview.asp?DOT=248555
Did you call 1-888-DOT-SAFT and report the violation?
Why didn't you take the vehicle for inspection after the the tread was below 4/32" of tread?
Your inspection history will follow you, I don't know how many drivers volunteer for inspections but I don't suspect it's very many. Most drivers prefer to avoid the delay and possible citation associated with the inspection. I know when I worked the POE, drivers would bring in citations from California and ask I sign off on the repairs being complete. But aside from that there wasn't very many drivers that volunteered.
I suppose you'll have to do athrough pre-trip, make sure the equipment is safe, write upo violations as they occur and have them fixed as required:
I've had 27 days off this year, drove about 106,000 miles and only earned $35,000 FOR THE YEAR!!! Why am I being the target for all these laws, obviously I am not the one getting rich by pulling freight! Maybe we should target those who are making the most money out here! It sure as hell isnt me![/QUOTE]
If no violations occur you will not be cited, any violations occur and you're responsible:
It's time to buck up and be responsible for your actions.
Be safe. -
I guess about 50% of these folks, shouldn't even be behind the wheel. Anyways,
Thanks Mike........... -
The driver are complaining now, this is all we hear on this forum. But, what about the carriers, they have to know what this means to them. But again, do you think they are going to us the drivers? The big carriers will not tell yo anything, most small one talk to there drivers.
When I drove OTR we were told in training that you put nothing on DVIR. We did all our right ups on the company supplied forms only.
These new rules will change driving for the better, it's going to force you follow the rules along with the company. You as the driver need to start documenting all the out of spec stuff. You must also learn what is and is not out of spec, you need to start reading the out of service rules now. You A/C system not working is not an out of service rules, you can be forced to run the truck or fired.

First let me say thanks to Mike MD, for his patience & for his time here educating us on the upcoming changes.
My first post in this thread was a bit antagonistic in the way I approached it. But I have learned from his responses & it has lead me to look deeper into the matter to better educate myself.
I understand that for the most part if a driver has been doing what he/she is suppose to do concerning pre & post tripping the equipment as well as doing the paperwork properly they should be fine under the new regs, in theory.
I have also seen companies forcing drivers to do things they shouldn't, not just the small companies either. Been fired for refusing to drive a truck with bad brakes. Been fired for refusing to run another load when I was grossly out of hours & a danger to myself & others. Now the companies won't say that but that's what these were.
I have seen DOT inspectors be understanding & give drivers a break. I have also seen his evil twin do everything possible to screw a driver over. I try to treat them with respect & hope his sex life is good, his kids aren't driving him crazy or he doesn't have something else going on that makes him want to be the evil twin.
I have even witnessed drivers not doing what they were suppose to, in my case I am taking the fifth to avoid incriminating myself, but I do love a big, fast large-car & I can color like nobody's business. Broke both of these habits back in the 90's though.
Never met a driver that given the choice, drive a good, safe truck or a piece of junk that might leave you stranded or kill you, choose the latter.
Never met a driver that given the choice, drive according to the DOT laws & you will make a good, fair, livable wage or drive 24 hours a day for next to nothing, choose the latter.
The government has let the industry/companies step down while forcing the drivers to step up.
As you stated,

You are the last link in the proverbial chain. Drivers will have to rethink the process they use to report unsafe equipment, i.e. locate the nearest FMCSA office and request a Level 5 vehicle only inspection or identify specific equipment by license plate number and call 1-888-DOT-SAFT.
Have you ever tried to push a chain forward from the last link?Last edited: Nov 25, 2009

Narcing on a company thru DOT hasn't worked. Not at the state level any way.
-
Going after these companies is not profitable. You shut the company down, you can't fine them anymore. And that's exactly why DOT remains focused on the expendable drivers. It's a money racket, as I said, and as mike was so happy to spell out for us.
