So first of all, I'll say this is partly my fault for not having my driver get it in writing at the shipper. But the contract I had was with D&D, not the shipper. I'm still not sure who's lying so I'm posting a review of both.
There was a hot load out of Advance Storage Products in Salt Lake last month. They had my driver scramble to get there and he got there at 6pm. No one was there so I called the contact number the broker gave me and they guy instantly said they're running late and they'll pay detention time. I called the broker to let him know but he already went home so I sent him an email right away, letting him know what the shipper said. They finished up loading him around 9:30pm and I emailed the broker again to let him know what time. I asked for an updated rate confirmation. A few days later I asked again and he asked me to remind him of the times. It happened 2 more times before he finally said, "the shipper claims he didn't say that but I believe you since you're not the only company to tell me that from that day". But he also went on to say he doesn't want to push the shipper because he's has a lot of loads out of there daily and doesn't want to screw up the relationship.
So I'm not sure what really happened there but their relationship isn't my problem, my contract was with D&D. Their terms state that 2 hours are given for load/unload and then it's $75 an hour after so I added 1.5 hours to the invoice and just sent in the paperwork. Probably won't get paid for the detention but who knows? At least I learned my lesson and will always have my drivers get detention times signed for on the BOLs from now on.

Yeah if you don't get the times noted and initialed on the bills they will use that for an excuse not to pay. Just chalk it up as a lesson learned.

Sometimes, they plainly refuse to mark the times on BOL. Them shippers/receivers may have sometimes their pride and ego and high enough "dignity" to even refuse to print their last name by their signature, which is something I always want to have and many times I got into some unnecessary squabbles over this. For drivers who are on paper logs to have these times on BOL may not be always that advantageous. A few times, when I knew that I deserved detention by the statute of the contract, and I could not get them to write it down or simply forgot, I did write down the times myself post factum and signed by those times as myself (a driver and witness) simply stating the fact of being there for such and such hours. Better that than nothing, it's not like I falsify anything. This way they would not refuse detention pay by saying it was supposed be on BOL.

Try to take it up with whoever the person you're dealing with's boss is. Most of the time management at freight brokerages aren't willing to fight about something this size. If that doesn't work write it off and don't haul for them again. If the RC is on your side you're probably in good shape with management though.
I know my companies RC's pretty much say 'we pay detention if we collect it from the customer' which we do. If we don't collect it we don't pay it. I tell everyone who hauls for me in advance "This is produce... these customers usually don't pay detention. That's a big part of why this load pays 3 bucks a mile". Sounds to me like this broker guaranteed you detention in writing, so it's very likely he's still trying to get the customer to approve it so that it doesn't come out of his pocket. 3.5 hours to get loaded isn't too bad. If i want detention for waiting pass 2 hours, i might have to fight 75% of my loads. Thats why i quit doing Van and Reefer loads. Drop and hook would be ideal.

I invoiced them for 1.5 hours of detention at $75 an hour and ended up having them offer me $70 for it so I called it good. I honestly expected them to ignore it so I'll give them credit there.
