No, I didn't know that 90% of small companies don't use DAC.
I'm still waiting on some companies to call back to me, the biggest issue is that my run with Werner was only 3-4 months. Most "small companies" in my area require at least a minimum of 1-year's experience, and I'm not sure how much I can fudge it.

These types of lawsuits won't work. HireRight is not the one that created the negative file. Your beef is with the carrier. Just as in the OPs case. They contacted the carrier and asked them about the drivers history. HireRight works much like a credit reporting agency. Take a drive down your local us hwy. There are more smaller companies than there are megas. Start early Monday morning in your search. Be sure to sell yourself.

I am seeing several comments about carriers that don't use DAC. That's true and its OK. The problem is 391.2x regulations about inquiries and investigations. They mandate a carrier have this information DAC and other 3 party businesses provide. They just have to get the work and DMV history another way. DAC, yes you don't need it. Part 391 still has to be complied with. Have sloppy employment records, risk serious trouble with the FMCSA.

Hire Right, is a "holding company" of sorts, for information and as such, they fall under the Fair Credit Reporting Act. they cannot add or subtract from what an employer said, and they cannot add or subtract from what you say, in a rebuttal.
if you do obtain a job then get turned down, due to a bad DAC/Hire Right report, then they are supposed to send you a letter, informing you of such.
most times however, a potential employer will not even deny you that job and say it was due to a bad report, they just see that report, and move onto another applicant, so you really would never know, if it WAS a bad report or something else that made them decide against you. -
The point is a company that doesnt use DAC is not going to care if you quit because forklifts poking the trailer walls was put on you. Not saying that's what anybody's saying happened here or anything.

I don't know where you live, but oilfield would be my suggestion. Halliburton, SlumberJay, etc. Give it a year of hard work and move on up.
