DAC Dispute Failed - What Are My Options Now?

    You are still missing the point. I don't really care who did what to who or why they did it. The information about job history is mandated to be got and maintained. Why you were fired or why is not the issue. Just as a carrier would not care as your example states, that same carrier won't care how they got the information. Again, that information is mandated PER the FMCSA. You can't legally hire anyone without it, or a dang good reason it is not there. This is why telling someone to go find somebody that doesn't use DAC is not a real solution, especially in today's world.

    Blacklist is a regulated lawful activity in some states. I was B/L'sted formally in Indiana by a trucking company once. By Indiana law they can only verbalize that special word on the phone or in person against me to so and so whomever is looking to hire me. HOWEVER I check against them in case I catch them WRITING that word against me in letter. I will take it to Indiana and seek damages. By now it would be rather extensive. It only took me about 3 years to understand blacklisting in general.

    After a time. That employer no longer is revelant and I can go back to hauling steel etc in the midwest as if nothing at all happened via them.

    Careful Sir, Kemosabi knows. I recognize that you are feeling a little warm and stressed at the moment, but I would shake the dust off and get into a company that does not require DAC. In time all that will be irrevelant. The key word is time.

    You have been doing well so far here. Hang in there. It WILL get better sure as the storm leaves you with sunshine tomorrow.

    I got 10 small companies within 25 miles of
    Where I live, who not only don't use dac,
    They hate dac, they hate mega's, and they hate
    anything and anybody who keeps them from
    Making a living.
    He'll get a job tomorrow if he looks hard enough.
    And he'll make more money and have more freedom
    Than he had at Werner.

    The mega's have brainwashed drivers into thinking
    That it's them or nothing else.
    This will be the best thing that ever happened to him.
    Now he'll get a real job, and be left alone to do whatever
    It takes to get the job done.
    Just the way it should be.

    I am not trying to say the OP can't get a job. I am not saying DAC is the best thing since sliced bread. I also know there are lots of carriers that will hire and don't use DAC. My point was and still is that information DAC provides is still mandated to be in the driver's qualification file. Its the law. Last week I helped a driver get on with a guy down in NC that was needing a driver. I don't think he uses DAC either. He just sends a fax with a signed release for Driving, DMV and drug-testing history. Easy, now hired and making money.

    So why was The OP fired? I mean 3 backing incidents might not carry the same weight as a roll over.

    And the class action lawsuit against hire right has already concluded. I didn't sign up for it or anything, but got a check for like $450.00 some years ago. It cashed lol. Just popped up in the mail box.

    I think if we all park the trucks for a few weeks and shut things down for awhile we could make real progress on these types of issues.

    Help me understand. So if you work for a company that uses DAC they're legally required to report that stuff, if any, in the drivers qualification file?

    I'm relatively new as a driver. I made the mistake of driving for Werner on their Dollar General account fresh out of school. They fast tracked my training time and put me to work right away.

    The actual contents of what transpired during my time with them is accounted for on other posts I have made on these very forums. Given the context, it's nothing major at all, and at the very least there is 1 out of 3 "incidences" that can very well be argued were not even my fault, let alone something that's preventable. I try to be very up front about the reality of what goes on, as I see a lot of folks here are skeptical and favor the "two sides to every story" line.

    The highlights of my career this new is that 1: I've never been in a major accident where anyone was injured or kills, no hazmat release etc. 2: I've never refused a drug/alcohol test, 3: Never had any felonies or criminal history.
