DAC falsified report(s) ?

    Who all here has experienced the unpleasant regarding DAC, otherwise known as HireRight putting falsified information on their reports? Doesn't OOIDA or something file suits on behalf of drivers for behavior like this? Personally they tied my social security to a license that wasn't mine in a state that I never lived in. They claim that I must have provided an employer who ran an MVR on this particular license the license nuimber to do so. Despite the fact that the CDLIS+ (not the same as CDLIS by AAMVA) was provided to that employer nearly four hours prior to the employer ordering the associated MVR and was provided by HireRight's CDLIS+ report. Oh yes, and I forgot to mention that this license in question isn't even a commercial license. Stands to reason it would not appear on any CDLIS report anyhow anywhere, I think at least.

    I guess I could upload the letter I received from their attorney. I used acrobat to highlight problem areas for them and marked it up with my own comments in red text and kindly sent it back to their attorney. CDLIS plus, is a HireRight CDLIS. CDLIS, the real deal, was established under the Commercial Motor Vehicle Safety Act (CMVSA) of 1986 and is based on the Federal Motor Carrier Safety Regulations (FMCSRs) in 49 CFR 383 and 384. CDLIS Plus is some proprietary thing to HireRight that includes info from the CDLIS database by the AAMVA and HireRight "multiple license pointer file". HireRight markets their CDLIS plus on their website to be one that "reveals state licenses that drivers may be trying to hide", and "lists additional states where MVRs should be ordered". And that is exactly the attitude I received when I have been asked about this license, that was reported to prospective employers when they saw it on this CDLIS plus report, that I was trying to hide something. Imagine the embarrassment.

    HireRight isn't counting on their own records, to include the CDLIS plus reports and the MVR both having timestamps representative of when each record was provided and in what order. Trying to claim they "don't know" how employers would have obtained that license number if I didn't provide it on an employment application. Say what? Why in the world would I list a license that belongs to someone else, in a state I never lived in, with a license number I didn't even know until a past employer finally showed me the CDLIS plus report to direct me to what he saw that made him ask to begin with?

    This is kind of lengthy. Long letter from HireRight attorney. I certainly found it comical. But if you all want to see the ignorance of this company who may be providing inaccurate or completely false information about you all, take a looksy. This attorney contradicts herself. I do have that application to Marten. And nowhere on it is a TN license listed. CDLIS maintained by AAMVA I am confident has not made this huge mistake that HireRight has.

    DAC/Hire Rite is regulated the same as a credit provider under the consumer protection act.

    You have the right to submit your 'correct' information and they have to list it along side the potentially erroneous information...

    i only read a tiny fraction of the letter. yes, it IS HIGHLY possible that someone else was born the same day and year as you.

    errors can be made, BY THE EMPLOYER mind you, when requesting information for Hire Right/DAC.

    DAC when it was first enacted was a "clearing house" or a holding house of information. they do not add comments or subtract them.

    they simply send out, what they took in.

    your beef would be with Marten or whomever else supplied information inaccurately.

    i have had the experience that DAC, Hire Right was easy to deal with.

    a case of mistaken identity took place, from the tiny bit i had taken the time to read.

    Nah. HireRight says "we don't know how marten obtained this TN license number". They do. It was provided by HireRight on the CDLIS report. Theyre just saying marten supplied them with it, when marten didn't. Unfortunately I didn't know exactly who the company was reporting this license until 2018. But the TN driver has the same last name and date of birth. That's all he has. His license even, isn't even commercial.

    In fact, initially on the phone they (hireright) claimed "we get this information from the government". Thats also not true. The CDLIS plus report Hireright markets is on the same page as the CDLIS search results maintained by the AAMVA. The AAMVA CDLIS only lists the two licenses I have ever held in my life. Hireright is the one listing this TN junk as mine. Essentially this attorney is alleging that I provided the license number to Marten on an application. Basically saying its my fault. Too bad for them i have the application and that number aint no where on it.

    and Hire Right would NOT Know how Marten got that information. they take in information, and turn around and send it right back out again. they do not make up stuff. could also be a totally different "Marten" company.

    just like i had once worked for a company out of Ohio, named, Victory Express.

    i'd be passed by another "Victory Express" company, different paint job, but same name.

    You'd have to read the entire letter. You'll understand then. Or don't. I dont personally care. Point is you're not getting is they supplied the license number to marten. Not marten to them. They forget the reports have timestamps on them. Don't know how marten got the license number when hireright provided the cdlis plus report nearly four hours before the mvr was ordered?
