    I got into an accident this time last year I just found out the company put it on my DAC report which I'm not surprised I hit a guard rail and had to be towed to a shop the question is how do I fight it the cops came but didn't write a report or give a ticket my concern is the company gave me a violation of reckless driving even though no report or citation was given im trying to switch companies but have been denied already by one because of this

    What companies report to DAC has nothing to do with police reports or tickets issued. It's a history of your driving performance while employed with a carrier not your MVR.

    In the company eye, you hitting a guard rail is preventable weather it was caused by reckless driving or any other reason. People just don't hit guard rails cause they are driving safely.

    I don't think you can have it removed, but you can add your comments to the company report.

    In the end, you screwed up and now have to deal with the consequences.

    Work for companies that don't use dac and you won't have to worry about it.

    Think local. But if you insist on doing long haul. Then don't work for megas.

    the only thing you can do is submit a rebuttal to DAC, maybe you hit the guard rail in bad weather? maybe someone forced you off the road?

    other than that, a company can DAC you for an accident or incident without a police report, or ticket. the mere fact it had to be towed away was enough for them to DAC you.

    this won't necessarily prevent you from getting another job, it just may slow you down a bit in finding one.this will be tough as you were DAC'd for RECKLESS driving....

    As mentioned, you can file a grievance/rebuttal (and most likely lose). Or do nothing, and get the same result. Find a company that doesn't use DAC....it's not hard....if they DO use DAC, they have to disclose it on the application, and have you sign for them to do the background check via DAC/HireRight.

    with a rebuttal one does not necessarily win or lose, it's a matter of having your say in what happened, rather than to sit silently and go thru the job denials in the future.

    many times too, DAC will contact the employer for thier response, sometimes the black mark is removed, sometimes not.

    much like a ticket one gets, he/she is ALWAYS advised to "fight it"....

    if you do not "fight it" in this case a rebuttal, it stays on the DAC file unchallenged.

    been there, done that.

    As have I.....and I won.
    The ONLY way it goes away, is if you win. No company gives a rat's behind that you contested it, unless you win (and it's not there to see). A "record" of your rebuttal means nothing.

    Even if he applies at a company that doesn't use DAC; he still has to list them as a previous employer. And if the potential employer contacts the previous employer and they tell thme he can still be denied employment.

    So, applying at a non DAC company won't guarantee a job.

    well i have had it both ways. i had misinformation removed, i have had alleged accidents removed, and i have rebuttaled other crap. whether or not a new employer gives a rat's butt as you say, is immaterial. it is there as your way of saying "i got my 2 cents worth in"

    i have been told by a former employer, that once they saw my DAC, they weren't going to consider me, but then someone else in safety read my rebuttal, and i got called in for an interview and to explain my side of the story, and i was subsequently hired!
