I'm seeing a lot of unfortunate stories on the board over ancient mistakes i.e. DUI's. Apparently, the DAC report runs your felony record from when you were born? I believe DUI's are felonious, no? I suspect they don't fall off your record then, like they do on your DVM report. So, if one turns up 11-12 years old... your stuck? Can these companies that advertise help? Or, do you just have to take your lumps AGAIN? Thanks!

They aren't felony's. Legally they are usually considered a misdeamor, but are a different kind of animal in the driving world. I never put down I have been convicted of a misdeamor, becaue they always ask about the DUI in a different question. They seperate them on the apps.
-
Hmm.. so the application question re: DUI's is open ended? Like, have you ever had one in your life??
-
Not open ended. They usually ask if you have ever been convicted of a felony or misdemeanor. Then a line or so down ask if you have ever been convicted of a DUI. Something similar to that. Key word is EVER. Then it's usually asked if you have had any accidents in the last 5 years, and or moving violations within the last 5 years.

I think DUI's only stay on for 10 years. My brother did the same thing...came home, caught his wife cheating, started drinking (he was irate) and flipped the truck over and took two telephone poles out and ALMOST was dead. He was LUCKY. After he waited 10 years, he was able to get back on. It was a long, costly mistake. He did fix it though.

If it was on a passenger car license it may depend on the state itself. Not sure. I know I got my MVR just a couple of weeks ago here in Ma, and it went all the way back to '92. Then I know some people in CT. and their stuff goes back only 5 years I think. But if it's on some criminal record or something who knows how long it's on there. If you can I would go and get an MVR and possible criminal check and see what is there.
If you know what's on there then you know what they will see. -
Yeah, see the "ever" word is the catch. If you pull your MVR and nothing shows up in your particular state. I don't know how comfortable I'd feel falsifying the application question. If they are able to tap into some obscure data base and find a DUI older than 5-10 years, now you are a liar. I don't know what the lesser of the two evils is; being honest and possibly opening up Pandora's Box, or falsifying the answer and run the credibilty risk of being caught lying on the application??? Maybe, I'm being too paranoid!

I have a DUI that is 28 years old. I list it on the application even though I probably don't need to. My explaination when they ask is that I was young and stupid back in college and that I don't drink any more. I am getting into trucking partially for the freedom. Last thing I need is stress from some lie I told on a job application. If the app says last 10 years I put no. If it says ever I put yes. Honesty is the best policy for your peace and mental health.

After that though, they tend to look at it as a case by case issue.
What was involved? Was their injuries etc, etc, etc. -
Every company is different on DUIs. Most of them are Outside of 10 years, the one i'm at (JBHT) states as such:
No more than 2 DUIs EVER. 1st one Outside of 5 Years (conviction, punishment, etc) and the other outside of 15 Years. (to make sure that this isn't a Pattern and that said driver has really turned the corner.)
