    I have a good friend who got sued because he was rear ended in a construction zone…by another truck. He was crawling along at 20 (he said) with a load of 70 foot pipe when another truck (daycab with an empty flatbed) ### packed him. The other truck hit so hard my buddies seat broke and he ended up in the sleeper. Yeah he’s a big boy probably 350-400 and 6-4 but you know it was a hard hit to break the back of the seat down….there’s no way the other truck was going to 45mph construction speed limit. Probably closer to double that if I was guessing. Unfortunately the other driver died because the pipe smashed him into the back of his cab…and his family won a lawsuit against my friend for a couple hundred grand if I remember right. So I guess if you’re going less than the speed limit you could be in trouble too.

    A driver could have done everything perfect, as far back as the ELD can record, and the truck will still get sued.

    It’s time to be done driving a truck. Not worth it, anymore.

    That would be why we should support tort reform. But nobody wants to touch that hot button issue. It's like supporting getting rid of medicare or medicaid.

    Well, the largest and most influential lobbying group in the country is the trial lawyers, followed by the teacher's unions and other union lobby companies, Pharma and medical related are something like 10th on the list. The lists that are created only look at money spent but not influence.

    Perhaps correctly sometimes the law-firms leave no possible aspect to chance to find any way to bring the deep pockets to court.

    Anyone driving for +/or under lease to a motor carrier is under their liability policy which covers the individual's legal protection.

    Rainy day on the NJ turnpike, insured driver following an SUV in the right lane passing the entrance ramp from an exit when a pickup coming down the ramp spins out striking the SUV making our truck the third person to join the party.

    Carrier's insurance denies SUV's claim; so does the pickup's insurance.

    Both our driver and the pickup driver, just before the 2 year limit, receive lawsuit for the SUV.

    This brings the carrier and the pickup insurance companies back in.

    Kinda sorry I retired before this one was settled.

    I'm thinking the pickup's insurance denied the claim saying the big bad truck did the most damage so in the end I'll bet our insurance paid more.
