Fact Sheet #19: The Motor Carrier Exemption under the Fair Labor Standards Act (FLSA) | U.S. Department of Labor
Section 13(b)(1) of the FLSA provides an overtime exemption for employees who are within the authority of the Secretary of Transportation to establish qualifications and maximum hours of service pursuant to Section 204 of the Motor Carrier Act of 1935, except those employees covered by the small vehicle exception described below.
Thus, the 13(b)(1) overtime exemption applies to employees who are:
- Employed by a motor carrier or motor private carrier, as defined in 49 U.S.C. Section 13102 (see Employer below);
- Drivers, driver’s helpers, loaders, or mechanics whose duties affect the safety of operation of motor vehicles in transportation on public highways in interstate or foreign commerce (see Employee Duties below); and
- Not covered by the small vehicle exception (see Small Vehicle Exception below).

every local cdl-a job i've had (3) paid ot @ 1.5. only one of those jobs was union.
id have spent a little more time looking before i bit on that particular job. if nothing else at least you'll be fit. -
Dumb question. I know you said you did the math, but...
And this actually confused a lot of people at work when we changed to it.....
Did you get paid 40 @ 20 /hr or did you get 65 @ 20 /hr? Our checks will show, for example, $20 @ 48 hours and then $10 @ 8 hours. It's time and a half , they just split it a weird way.kylefitzy, tarmadilo, Cattleman84 and 2 others Thank this. -

In certain states (CO, NM, NY, WA, MA) truck drivers may be entitled to overtime pay under state law, even if they are exempt from the overtime requirements under federal law.

Consider yourself lucky if you're with a company that does pay some type of overtime. -
70 hours at $22.5
30 hours at $11.25
It ends up being $33.75 after 40 but it looks strange seeing $11.75. -
The OP's version is they only paid $9 per hour for overtime while his base rate is $20 per hour.. OP.should post his pay statement so someone here can identify whether its a clerical error or he just got screwed.
