I like how companies always give you that paper that says its "at will" employment and you may quit or be terminated at any time, for any reason, without notice. but then this crap happens, but had they fired you without notice it would be ok

1. Before telling the company anything, request home time. Get all of your personal belongings off of the truck when you get there.
2. Give notice to company
3. Line up rental car as soon as you know when and where you'll be turning in the truck.

Some companies may not require an ADVANCED notice before quitting,but that doesn't necessarily mean that you can just drop off their truck at any convenient terminal of your choice and simply walk away without notifying them and/or getting their permission. They might have really needed trucks at one terminal and maybe had an overflow of too many trucks at another terminal. If you know that you will be passing by a terminal call them AHEAD of time and politely ask if you can drop it there.I have done that before when I was a company driver with no problems. Sooner or later you will be passing by a terminal anyway. Always read the fine print.Some companies may require you to return the truck to the terminal of their choice.

Second, you CAN choose to walk without notice. But is it the honorable thing to do? Certainly not.
And, the company decided to notify HireRite. Since you didn't ask them where to leave the truck they can call it truck abandonment, which is a serious charge.
Had you asked them where to leave the truck, rather than just dropping it wherever you thought may have been convenient at the time, you would then have had more of a legal leg to stand on while disputing the entry on your DAC report.pusherman, rexmanno and joseph1135 Thank this. -
just to set the record straight and to see if he will tell us the truth, I have first hand knowledge of this.
1) he did sign the repayment when in orientation that says if you quit and leave before a certain time you will be charged back the cost of the physical, DS, hotel, food, and travel expense and oreintation pay ( which is given to them at the end of class )
2) he lives 40 miles from the terminal yet chose to stay in the hotel that we paid for instead of driving back and forth everyday
3) he was at home on medical when we got a call from another company that he was in their orientation and they needed his information so they could put him in a truck.
4) he was hired to do short haul flatbed, home every day and every weekend
5) his dac says he abondened at terminal without notice, which is exactly what he did. we dont put untrue stuff on the DACDriverMike1984, REO6205, Triumph and 1 other person Thank this. -
With technology we have today I'm not sure why people don't document everything they possibly can. I'm trucking to pay off undergrad student loans so I can go back to law school and from what I already know about the law is you're better off to store as much evidence as possible.
If you are going to drop s truck at the terminal like in this case, fine, but use your phone video camera to document what you're doing and where you are. Also, do the same if you do to your dispatch office to quit. Have that camera on as much as possible so you can eliminate the whole "their word vs mine" problems.Last edited: Jan 6, 2015
