Detention and layover will not be paid on this shipment

    New one, on a rate con I signed without fully reading, for a new to me broker.

    Not sure I have seen this before, have you?

    Needless to say they are on my do not use list now, after I ended up with over 5 hours at the delivery.

    My fault I am not getting paid for my time, but come on, what kind of lowlife puts this on a rate con?

    I have seen this. I never agreed to it. Its the same low life that says they will pay it, then don't.

    I think there's a lesson to be learned here. Brokers aren't your buddies, and the less you have to deal with them, the better. In all my years, broker ALWAYS equals a shyster. Okay, so you got bilked for a couple hours, I think the more important issue, is to read the contract, even if it takes an hour.

    Common when doing produce. No detention but paid layover. The rate usually reflects the hassle and liability.

    I have seen that on rate confirmations from Coyote and TQL. To be fair with Coyote it was an only one time occurrence, I removed myself from the load anyway

    If the rate is good enough and I want the load then I might agree to those terms. It can not be stressed enough that you need to read the rate con before you accept it. Don't blame the broker or the shipper after the fact when they told you in advance what kind of service they were willing to contract for.

    Er, no.

    He's telling you he won't pay for it and giving you the opportunity to accept or reject those terms. That's an honest tender offer and is in no way the same as being told you will get paid and then getting stiffed.

    Granted. Contracts are contracts. You sign then you agree. But they cannot be a tool of a mischief either. All those fine prints, things which are stated verbally or sneaked in by a hope that your eyes would not catch them in the print are nothing else but fraud. The kind of fraud that is hard to argue in court. The broker was a lowlife by withholding the crucial information or not being explicit about it.
