Putting all the wire tapping, back in my day, meat haulers are special bs aside.. The bottom line is this. The man said he was tired, he tried walking it off, red bull, etc. He was falling asleep at the wheel. End of discussion. I don't care if the second 10 hr break isn't in the picture. If the driver just came off a 34 hr reset and this was his first load, and it was so tight that he didn't have any nap wiggle room. If he's falling asleep, then the load gets delivered late. Period.
Now, as long as it's an isolated incident, fine, let it go. If it happens a lot, someone needs a new line of work.
Everyone here who has driven a truck for any length of time knows what it's like staring through the backside of a windshield. The miles get long and boring. Most jobs if you doze off at your desk, you catch your co-workers putting toner in your coffee cup. Here, you wake up just as your about to have a head on with a school bus.
Every driver is different. Personally I could of slept another 4-5 hours on the second 10, but that comes from years in the army and driving truck. Not everyone is wired that way. But.. Only you know how your body responds, and he should of said when they gave him the load what his issue was and that the load wouldn't be on time if he took it.

We should probably check that driver for sleep apnea, I'm sure he's probably got it....
Anyone who can't stay up all night, when they're used to being up all day, obviously has sleep apnea....
We need the Fed's to do some studies, I'm thinking....
You know what I'd tell that dispatcher, if I was a company driver, that is.....
I'd tell him I've got unlimited cellphone minutes and a bluetooth headset, why don't we just stay up together, we'll pull an all-nighter, and by morning we'll be best buds....I'll stay up and drive, and you stay up and talk, and not at home in front of the old t.v. either... you set your rear end in that seat staring at the monitor while I gaze out the old windshield....

When you are tired there is only one thing that will help you, and that is sleep. Red Bull, Coffee, doing jumping jacks isn't gonna keep you awake, your body will shut down eventually if you are tired. Ever heard of microsleep, it's a condition where you pass out for a few seconds from being tired - very nice thing to do when you are driving 80,000 pounds down the road and the car in front of you is a family with kids who you may crush and kill.
The DRIVER would be the one GOING TO PRISON if he falls asleep NOT THE DISPATCHER. Remember that drivers!truckerdave1970 and NavigatorWife Thank this. -
