Dispatcher tries to force driver to drive tired. *MUST SEE*

    Im not going to respond to all the negativity.Ill just keep u all posted as to whats happening.Abe sent kb the video before he uploaded it to youtube.Reason he posted the video was because of the lack to care on his disatchers part.He finally had enough.

    With many of the posters who have yet proved that he did not try to sleep, or the dispatcher did not try and call many times during the second break with updates on the load, or if the truck could idle and he was freezing.

    Got to love the drivers who criticize another driver without facts or thinking it through.

    I respectfully disagree. It has EVERYTHING to do with this thread. Nobody in this thread is saying that he should have driven if he was falling asleep. That is not even up for discussion in this thread so let's take it off the because you pro Abe guys keep using it to muddy the waters.

    This is the real question. If I am the boss , and an employee tells me that he cannot drive another 162 miles after only being awake for only 12-13 then I want to know why. I am not going to coerice him. He can shut down and explain it to me. Do you have a cold? Did you not sleep well on your first 10? Do you need a sleep apnea test? What is it driver..... because it ain't normal.

    If he tells me his circus rythms are messed up then I will say he is not the type of driver I am looking for. I guarantee that if he was headed for home he would have made those last 160 no problem. What a joke.

    We're not in a court of law so I really don't need to prove anything. I've formed my opinion of Abe based on his current video as well as the others he has posted. He can't honor his commitments. Aside from a few drivers grabbing their picket signs this story isn't going any further. Abe might and should be replaced with a driver who wants to work. He needs to spend less time making videos and playing world of Warcraft and more time working.

    The simple answer is this, if you have a driver who is legal to drive, but is refusing, you don't try and compel him. You quietly make a note of it. If the problem persists, you get rid of the problem....

    Not really but here goes.

    The company identified the violation, contact the driver and done their due diligence. They've made efforts to gain compliance from the driver who refused. They could have escalated it more and said they were going to notify the police. But it hardly matters, when the lawsuits begin this will just be step #1 to the investigation. A good lawyer is going to ask for the logs for the previous 6 months, pull phone records and GPS positioning and Qualcomm (or whatever system they use) communications to establish patterns. If they can establish a pattern leading up to the incident the details of incident no longer matter, their case has already been made. If the driver has a pattern and the company has a record of increasing discipline leading towards termination they have more of a leg to stand on. There are multiple factors that would go into deciding who is at fault IMHO.
