Dispatcher tries to force driver to drive tired. *MUST SEE*

    I understand where your coming from, my point is what if he didnt nut up and stand his ground and caved into the tough guy on the other end like some might and killed someone on the road. Even if he did not record this if an accident happened im sure those phone lines most likely are recorded. Im not siding with anyone here but im just saying what the consequences could have been.

    Why can't it just boil down to this?

    Company failed to properly use resources, driver/equipment. It is rather counter productive to take a 10 hour break, move a empty trailer for a short distance and take another 10 hour break, just to sit all day. I would lay down and attempt to power nap. Almost impossible.

    Driver should have told dispatch from the beginning that did not make sense, was not workable and explained why. I do not want a tired driver on the road.

    I've read the threads and imho, some of you just don't get.

    You cannot drive on 5 hours sleep, be fully alert and safe.

    You cannot change your sleeping habits on a whim and be fully functional.

    And yes, been on the night shift, drive varying hours and all that.

    Difference? Knew it beforehand and could plan on it.

    The comments on the video? Just another company focusing on a load and nothing else.

    Threats made? Heck yes.

    Should abe look for another company? yes

    I am not sure what state they are in but in mine, posting You Tube video would probably get you terminated without pay. And it would probably hold up in court because you are supposed to act in good faith, he honest, do nothing to willfully harm the employer, not be insubordinate and not refuse work that can be done safely. He failed at least one or two of those tests.

    Just sayin.. I don't think I've seen a thread gather this many eyes at once. And in the middle of a work day. I'll bet there's some circadian rhythms being thrown out of whack on account of it. I'll check with legal counsel.

    Abe was force dispatched on a load requiring him to drive at a time his body was shutting down. A person cannot sleep all night the prior night, be expected to sleep all day immediately thereafter, and then expected to not be too fatigued to drive the next night. The circadian rythm (or as you prefer "circus rythm") is the biological process which allows a rational manager or load planner to predict a service failure or wreck is most likely to occur.

    Abe followed federal law as it is illegal to drive a CMV when ill or fatigued (per 49 CFR 392.3). There is more to the law than the 11hr, 14hr, 10hr rules regarding when a driver can drive. This is your hangup, I think.

    You agree Abe was safe by stopping and professional (he notified dispatch). I can't say the same for K&B mgmt., especially in how they lied to law enforcement, saying they had not heard from Abe in many hours and were concerned about him. They lied, they had just spoken with him 2 hours earlier, and knew he was in a deep sleep stage and would need somebody to go try to wake him so the load would not be late.

    K&B is a disgusting excuse for a company. I'm truly sorry for you that you cannot understand that.

    Use the back end of a mag light. That will get him out fast, plus you can use the same to put on a few lumps if he comes out with the wrong attitude.

    Yes you are exactly correct IMO. This is exactly what the night dispatch told him also. Those weren't threats. That was a service failure that they gave him because he accepted a load that he could not deliver. "Next time if you cannot do the load, you need to communicate this with your daytime dispatcher" is almost exactly what the night dispatch told him.
