Wait a minute...the driver did have his ten hour rest, but immediately after the first ten hour rest he was dispatched for twenty minutes only to go back on a ten hour break which is where the problem lies.
So..the driver takes his first ten and is ready to go, but there is no load for the day so dispatch sends him on a twenty minute run (?) and then tells him to take another ten hour break (?) ..( meaning sleep ) which is impossible..so 'by law' the driver was 'legal' although on the following load he would have been working/awake 24 hours straight.
I would hope he has a lawsuit against K&B.

The intent of the HOS laws is to prevent a company from pressuring drivers to drive on public roads when he is to tired to do so. That would be unsafe and irresponsible. It is not a game of numbers like some of you think; the law has intent. The consecutive 10 hour breaks interrupted by the 20min work load are just a loophole in HOS law that was exploited by K&B planners. No law can cover all circumstance and make it simple enough for some of you to understand. K&B violated the intent of the law and tried to cover their butts.
Common sense and anybody but a brown nosing super trucker would tell you what they were asking of Abe was unsafe. They are responsible for their unsafe actions. That is exactly how any jury would see it.
If that was not apparent enough for some of you the DOT spelled it out in yet another HOS law:
392.3Ill or fatigued operator.No driver shall operate a commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate a commercial motor vehicle, while the driver's ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe for him/her to begin or continue to operate the commercial motor vehicle. However, in a case of grave emergency where the hazard to occupants of the commercial motor vehicle or other users of the highway would be increased by compliance with this section, the driver may continue to operate the commercial motor vehicle to the nearest place at which that hazard is remove
This has been posted many times already, and for those that read, spell it out conclusively.
