I agree with you but everything you don't know can sneak up on you and do so much damage that you might not ever recover.
The question you asked in your op was a first year rookie question that you should have known the answer to before you ever sent out a driver.
Hiring a driver who requires that the DOT speak in a certain manner...slower, plainer, whatever...in order to be understood wasn't a good move either.
A company usually gets the kind of drivers it deserves but don't forget that a bad driver casts you in a bad light. If you're going to make it in this business you need to get your head into the game.

Yep and there is a lot to know. The reason I thought there may be some sort of exemption / rule for DOT stops that I wasnt aware of was because of something a trooper mentioned while I was on the phone with my other driver that was being inspected on a different occasion.
Thanks for your feedback. My driver who doesnt speak English well definitely gets hit harder during inspections. He isn’t a bad driver. Works really hard. Good drivers are hard to find, so I have to take the bad with the good. -
When I worked for one of the big trucking company. They said when they got audit at terminal by D.O.T. the first set of log they asked for were the ones that had road side inspection. Because they had access to all the inspection report so they could double check those very easy. They wanted to maket sure drivers logged the inspection time

Now that's different.
We are required to understand enough english to converstation with the general public more or less and follow highway signs of a common and uncommon nature in english.
I had to carefully review what I was saying here today in the OP's situation to see whats what. I was thinking inspection time. Now that the quality of the driver is not there for sufficient english... well thats a minus.
If someone was able to talk with him in Orientation before hire it should have been obvious that english would need some work... unless if I am allowed to make a mental connection towards potentially a company hiring this person might also be relying on some other than English language as it happens around the USA. Ive had to take on some spanish, russian and german later in my trucking days depending on where we all were going. Because english is not a preferred language.Upinsmoke Thanks this. -
One can appreciate a good driver. Lets try to keep him in english more maybe? If people in the company talked to him alot by phone etc it will only improve english like the book says iron sharpens iron.Upinsmoke and Atlanticus trucking Thank this.

I was questioning whether it was on an inspection? If it was it’s not a warning to the feds, it’s a violation. Somewhat strange because it’s not just a violation but an OOS violation.
COMMUNICATION
In recognition of the three countries’ language differences, it is the responsibility of the driver and the motor carrier to be able to communicate in the country in which the driver/carrier is operating so that safety is not compromised. Driver is unable to communicate sufficiently to understand and respond to official inquiries and directions. (391.11(b)(2)) Declare driver out-of-service. -
Ok that settles that then, I learned something tonight. Thank you very much. This gospel chapter and verse from DOT regs settled the matter. So. DOT Tinpot cannot make driver understand and so OOS. Ok fine.
