Do I get an attorney and if so, what kind?

    I'm very new to the trucking industry and I've made some rookie mistakes. Two times I've hooked my trailer tandems when making a turn on some tight streets. Each time it happened there was never any property damage or to the product I was carrying nor to the truck or trailer. The only cost was having a wrecker come to pull the trailer wheels up on the road in which I was able to drive away from that point. Was never cited by police and no reports were ever written or filed in the matter. After leaving Schneider National they had proceeded to post it to my DAC report. Can I fight this and if so, what kind of an attorney would i get in order to do this? Thanks for anybody's help in the matter.

    It has nothing to do with cost or being cited it is your history of making bad decisions. So, you want to fight the truth being told about you? And when down the road you have another 'none event' that hurts someone and they find out about your other 'incidents' that you covered up how will they treat you?

    *I don't doubt you will find a lawyer to take your money, it's what they do.

    If this is the truth as you have spoken it, and if what Schneider has reported to DAC matches what you say happened, then you would have no recourse as to changing any of it, you can't keep someone from telling the truth. What you need to focus on is "ALWAYS" give yourself enough room on the turns. If you start a turn and see that you are not going to make it, "STOP", get out of the truck and make sure that you can back up, then back out of the turn, if it means that you have to back out five feet, then get out of the truck and look, then back up five feet more and get out and look, until you are clear to start over with the turn or go to another intersection, then that is what you do. It cost the company a lot of money to correct "YOUR" error. If in time you get enough experience with Schneider that you and they think that this is never going to be a problem again, you "MIGHT" get Schneider to remove this from your DAC "IF" you were to offer to pay the costs for the errors, this is only a guess and should be considered as such.

    Waste of money really, you messed up and we all have at some time or extent. Learn form your mistakes and move on is the best thing to do.

    Well if it's any bonus in the FMSCA regs it does say if a truck runs in the median or off the road and needs a wrecker to pull them out it is not considered an accident.

    So if they dinged your DAC with an accident you might dispute it on them grounds. I'll see if I can go find it.

    Just remember you need X amount of room to make a turn whether you have to pinhook early, go around the block with all left turns or stop and wait until traffic clears. Pretending you are in a 4 wheeler is not an option as that trailer doesn't listen. brb.

    at least your responce shows that you're willing to accept the truth, all good responces. (does your name represent trying to pull the trailer out of the ditch)? pay attention, take all the room you can, good luck.

    Honestly, both times it happened, I had slid my tandems far back and I misjudged the turn compared to when my tandem was more forward earlier. My trailer was just barely on the end of the should when going around the turn but it happened none-the-less. As for the userid, it is a generic userid I use on my performance car websites. Easier to remember. I'm not trying to cheat the system just trying to get a job again.
