There was a similar post a few months ago. The 0/0 drank a few beers in his truck then went to bed. A Prime truck hit his truck and damaged the front end. The police came and guess what; the 0/0 was arrested because the police smelled alcohol on his breath. He lost his CDL. Didn't matter if he was off duty or sleeper berth; he was still in a commercial vehicle.

Sorry CT, I call BS on this. If he had alcohol in a container in his rig, maybe.....
If he was legally on a 34 and just came stumbling from the bar with it in his blood only, not so much....

He was on a break. Don't know if it was a 34 or 10 hr. break. He drank the beer in his truck while on break. That's what was posted on here. I don't know the facts personally; I'm just telling what was posted on here.I quit drinking years ago. Isn't it illegal to have alcohol in a commercial vehicle?

Beer in the truck is different than coming back to the truck drunk

Yes, the 0/0 said he does that all the time while on long breaks and didn't know it's illegal. I used to do the same; after a long hard day would enjoy a cold beer then climb in the sleeper. I wouldn't do it now though unless someone can show me in a DOT manual that it's legal. I don't drink anymore anyway; quit about 15 years ago.
