Does a DAC Report Include HOS Violations ???

    I have a driver who has been working for the same trucking company for over ten years and has been seriously thinking about buying her first truck. This driver will take her truck and lease it on with a different company. In the ten years that this driver has worked for the company, she has experienced HOS Violations, some in the last few months. The company has had an ELOG System in her truck for the past four years. The company has never addressed the HOS violations with her, they just keep letting her drive. Now, if this driver buys a truck and leases on with another company as an Owner Operator, will the HOS violations appear on any driver report? (MVR, DAC, etc.) Will this negatively affect her ability to lease on with another company?

    NOTE: Take away the HOS violations, and this driver would be ranked 'Top of All Drivers' in any trucking company, large or small.

    If no citation was issued there was no record unless the company keeps records. Companies only have to retain logs for 6 months. After 6 months it's like it never happened.

    If no citation or out of service issued nothing to report. It wouldn't even show up if the company she was with while the violations occurred received an audit. It would hurt the companies rating but there is nothing there to report unless she receives an out of service or citation.

    I think she's good to go but it doesn't hurt to get a copy of her DAC from hireright.

    They can check her csa score. If they think it's to high for their safety dept. Then they may not take her. Alot of companies are getting serious about this, as it shows the driver may or may seriously thinking safety.

    What do you mean she "experienced" HOS violations? That's a funny way to put it. Did she get any tickets? If so, then they will be on her PSP and MVR reports. If it was just a matter of some internal company process that caught her then the company probably will not put that on her HireRight report, though they can put anything they want on it.

    Even if she has a violation or two on one of those reports a prospective employer might hire her. It's completely up to them as long as she still has a CDL. I had a false log citation on my PSP report when I left Swift and I had no trouble getting hired. No one even asked me about it.

    You can get copies of your PSP, MVR, and HireRight reports. No sense worrying about something until you know it actually is something.

    I have a theory on this matter. This is a fairly new copy of my DAC. When I drove for Sccccchhhhhhnnnnneiser last summer locally on e log, I violated my 14 twice, and forgot to log out for my break once ( at which time the QC started freaking out so bad, I almost tossed it out of the truck for fear of detonation ).

    They only show Tickets or Accidents / incidents. I think if you don't receive a citation it never happened. Cause the people were HUGE ERECTIONS, and if there were a way to hump the driver with a pencil or pen, they would surely do it.

    I pulled a reefer locally, but they show OTR / van, my theory for that is probably do to the pay scale, or just one size fits all reporting.

    DAC limits the information to the check boxes on the termination form. this limits the amount of info a former carrier can list to those check boxes. Other than accident and drug and alcohol violations the abandonded equipment and personal contact requested are the worst check offs...

    Tickets don't go on your psp. Only inspections and violations are listed. So log violations would be on the psp. As we get those from an inspection. But not as a ticket. I've had 2 speeding on my psp. As part of inspections. But no citations were issued.And i've had 2 log violations a year apart. I think. Might be 3. They don't go on your MVR. They're not moving violations.

    DAC only lists things that pertain to work ethics. And how bad your company wants to smear your GOOD NAME. The way they'd find out about the log violations would be through CSA. One violation is worth 30 points. And shouldn't hurt her. Two might be cause for concern. Depending on the company. And if they're close together.

    How many does she have? And is she trying for a long haul operation or a local operation? Locals more then likely could care less about CSA.
