Customer allows parking...If not stated and I am waiting and concerned I may need my 10 hr break before I can leave, am told "ok we will put your trailer in the yard, we wont wake you just get it when you are ready."
2 hours later, pounding on door. Pounding again. Wake up in daze to see what is going on..."Since you are awake, we need you to move the trailer out of here."
3rd time it happened, I argued with the guy, as I had gotten a log letter for doing this, even writing in comments "was told to leave" sending obc msg about being forced to leave, etc. He kept insisting, well just get the trl, scale it then park again. I wasn't able to do it, I was disoriented. I got on their cb channel as all other drivers that were stuck there having same problem could here and said the same thing again "what is going on? I told you I am over hrs and cannot drive, you said I could park. You wake me up in 2 hrs wanting me to move the trl around when this was all prearranged. I can't do it, my company wont let me, the DOT wont allow it."
A few minutes later, yard dog pulls trl out and sets it beside my truck. I finish my break and hook exactly 10 hrs from when I arrived (even though technically I was dropping an mt, bobtailing around, etc but wanted to get out of there before more trucks came in morning).
Am I actually protected and able to do this or is this something you are risking a fine for because you "should not have accepted the load" bs. Even though the shipper is allowed 2 hrs and took 6?

Well, I can't answer your question, but I can add to your question....
My hubby was kept for 4 hours at the Port of Oakland, and then forced to leave by security. Was told it was a threat to National security. (I'd still like to understand that one!) He had to leave right at his 14 hours! He got caught in Bay Area traffic tryin to get to an area where he could park, and was pulled over for something..
The officer did not ticket him on whatever it was that he pulled him over for, but did write him up on the log violation. And then escorted him to the very same place hubby was headed for. AND the OFFICER told him to fight the ticket!
So we are fighting it, and have been for over a year and a half. The judge keeps asking for more info, first from us, and he has now been after the Port for over a year. And the JUDGE keeps delaying things. I wonder what he is trying to do?

Have never been in this position, but I have never planned my break at a shipper or receiver either unless I know the place and know what kind of parking is available.
I can imagine your position though, which is why I don't know if I could do this job for a company that monitors my every move like this. -
Yes you are Risking a pile of crap you don't wanna Deal with, or maybe your board and wanna deal with it... they can call the police and Report Criminal Trespassing on Private Property when the Police Come Tell them you cannot move the truck its illegal if they demand Call State DOT, when DOT Arrives Explain Situation tell them you cannot Move you would be Violating Federal Law and risking your job by doing so, if they Insist Demand DOT Call FEDERAL Marshal to Come and Drive the Truck for you..... I pissed walmart off really good doing that once but you have to stand your ground.. and it takes a while before everything is said and done...

I waited for the longest time to decide to come here because my friend always talked about taking breaks at customers and I thought "no way, I'm going to a truck stop when I'm done whether they like it or not."
But then I learn that with more pay comes these loads that may run your clock out more often than not. At first, they look the same, just a little tighter schedule. You do a load that looks almost the same as the one you did at a previous company. But the previous company although they were the lowest bidder, cleverly put in "extra fees" that made it so they better load you and unload you fast and save money.
I used to have a record time of 4 hrs for an unload and maybe 3 hrs for a load. Although for the most part, things are normal, I have ran into a lot more 6 hr load times, and 4 hr unloads. And that's why I try to be the last one there to load and the first one there to unload (load at night, overnight it so you arrive early in the day).
I got stuck with a day load no way around it so I need to take a short nap and load up and get out of here. Heh, this place I tried to talk them into loading me 12 hrs early, but they are not equipped to get me in. But they let me park on the road which there are a lot of trucks doing right now since it is a new area and this is the only business here so far so it's not all that bad. Yet -
At one place I left, the only damage was my 10 hr break started all over again because my 14 weren't up. But I was in Detroit at 2am and was trying to avoid driving around looking for parking and adding miles, which they don't like. So I had to break and get sent home instead of being stuck with a load cutting my home time, so that one worked out
But most of them I'm dealing over 14 when they do that. -
no one can give you a parking ticket on private property.
