DOT audit and drug testing

    Hello, I always read these forums on free time and got a question myself..
    Three months ago I got my own authority. Before that, I worked for a friend under his MC number for about two weeks while I was waiting for my MC number to get approved. I have done drug testing for him, and now I find out I had to do it again for my own MC number even after two weeks later.. I want to go and do it ASAP, but is it too late for my future DOT audit, and they will close me down? Or give fines? And is 3 months a big deal for them?
    And if I show them my drug test for different company while my MC number was being approved and then show him drug test for mine 3 month later will it help?

    You're screwed!

    Part of having your own MC number is that you play by ALL the rules. Get enrolled in a consortium IMMEDIATELY and when you have your audit plead for his forgiveness. This is one thing the auditors have little flexability on...good luck!

    They're not going to close you down. So long as you can show a drug test for you (and whoever else is driving under that DOT number) you should be good. As far as the audit goes, if you have logs showing you began on 7/1 but YOUR DOT drug screen was done on 10/1 ... I don't know how that would be viewed. Keep those prior results and add them to your company file as if it was yours and keep your mouth shut. No one would probably ever notice the carrier name or put 2 and 2 together.

    The other thing that is important for mid-large carriers is to be able to show a "random screening plan", but I'm not sure what the DOT will ask for in regards to a single driver owner-operator type setting. Are you supposed to randomly test yourself? I don't know perhaps someone else could better answer.

    if you have copy of one you took for other company and it's within 3o days I
    was told that was good. foleys will backdate to the last pool date too

    He is supposed to be enrolled in a drug testing consortium and he was supposed to do a pre-employment test.

    You need to understand the compliance requirements. Completely. You need to have a drug and alcohol program, even if it's just you. This includes a pre-employment drug screening, but there are a slew of other things as well. Get the facts quick and get it all in order. This should help:

    You also need to have provided yourself and your drivers with educational materials describing the horrors of drug use, etc.

    You also need supervisory trainig, one hour of drug and one hour of alcohol training in order to oversee your drug testing program and be able to conduct reasonable suspicion testing.

    Even if you defer to a consortuim YOU are still responsible to know what the reguations are. Using a driver without a pre-employment drug screen is a $500.00 a day fiine for every day you use the driver w/ out the drug screen.

    Drug and alcohol regulations is one area where the auditors have little leeway and the $500.00 a day is one of the fines the DOT will not reduce!

    your first audit is NOT TO SHUT YOU DOWN OR FINE YOU its is a audit to HELP you into compliance no big deal been thru it get your ducks in row.have both drug screens handy also 6 months logs fuel tickets trip reports maintenance files you need to have driver qualification file app, driving record, very easy and nice experience best part about it barring no big problems wont see them again

    The audit is to help you just get in one asap.

    YOU DO NOT HAVE TO DO THE TRAINING PROGRAM UNLESS YOU HAVE EMPLOYEES.

    Just look it up, do what the website says. I'm enrolled and they just calk me every once in a while. This time period is different but I'm sure your OK.

    Just learn what to do next time. I called ooida and they sent me out a check list I did it all and i had no points deducted
