DOT knocking on door to wake you up is this legal?

    That's the only time I saw a driver arrested that I can remember. I have seen COPs tell drivers to leave many times. With the exception of that time in Phoenix every other situation the driver found religion and moved. Once when the wrecker drove into the property the driver decided to move. He still had to pay a service charge for the wrecker.

    The charge won't be trespassing. You are right, that is a two part charge. If you refuse to comply with official lawful orders the charge is OBSTRUCTION. It is NOT a two part charge!

    Oh ok. You said you’ve seen it numerous times. I’ve been out here 25 years and have never seen it. Thought maybe I was missing out on something.

    One more point about trespass. Every state is different, but the basics are still the same. You have to be directed to leave the property by the owner or the owner's representative first. Then if you come back it is trespass. However, if you refuse to leave within a reasonable amount of time you can still be arrested for trespass. This LINK is a basic summary of Virginia's laws!

    That's because most of the time drivers are not told to leave a Truck Stop much anymore. Years ago most truck stops ran off the lot lizards using trespassing laws. The states also do this in the pickle parks. The entire atmosphere around trucking has changed over the last 40 years.

    But, you’ve still only seen it once? I mean someone actually getting towed. I’m not talking about hobo’s and ######. I’ve seen the cops called on them a million times. I want to know about the several times you saw a truck get towed. I have never seen it. I’m sure it’s happened, but you said you seen it a bunch. Heck I’ve only seen maybe 3 trucks catch on fire and burn up in a truck stop. I figure that’s way more common than a truck driver actually refusing to leave.

    I just told you this does not happen that much anymore. I have been retired now for 10 years and have been around truckers for almost 60 years now. To give recent examples would be like comparing Apples to Oranges. The towing does NOT happen these days like it used to happen. It still happens every once in a while. I have also watched Police and paramedics pull dead drivers out of their trucks more times than I care to count. I'm going to repeat the last sentence of my last comment and exit this thread.     Years ago a crazy lady that purchased some property around my current home ( house wasn't built yet and I lived on the other side of the farm) called the police and claimed My truck was parked illegally on her land.
    Police showed and had tow truck there ready to hook up until I showed up to start my day! What a #### show that was trying to explain that I owned everything even the road leading to my property and the 50 acre field between her property and where my truck was Parked!
    Not sure but I think she got charged for the wrecker having to come out there.
    A few months later she tried to have trucks banned from the local roadways, then again when that failed she went door to door with a petition about safe and responsible farming in a nieghbor hood where everyone was a farmer, landscaper, tree trimmer or truck driver. Needless to say after one winter and learning that roads don't get plowed at all times of the day and night in the boonies she sold her house and moved back to the city. Good riddance!

    I can see being asked to move if you are on private property or parked in a No Parking zone. I fail to see how anyone can be forced to pay a service charge for a wrecker. The person that called (property owner) is the one that ordered the wrecker. They may try bill you but as far as getting paid that's another story. Of course this is MHO.
